BARCOM 2/1105 Cotte~ Landmth, Kramer Architects 410 Peoples St. Corpus Chrigd, IX 78401-2318 Attn: Johnny Cotten ReE Police and Fire Public Trakfing - Phase I In reference to the stockpiled material on Flint Hill's property It has I~'en determined through multiple meetings and e-mail correspondence that purchasing an acre of property is the easiest solution to our ~tockpile dilemma_ I under, and that the access agreemenl, which was discussed with Om~y Carriger, was not given before we banled the stockpiled material to thc prol~n'y, however I do not think we should be ~esponsible for all of the land pu~has¢ cost for the city. The stockpiled localion was shown on the plans and approved before I stamat construction, which now ms like it w~uld not tmvc been an option knowing what we know now about testing. Flint Hills has ~id that the te~ng was a requi~ment f~om day one, ifth/s is con. ct I believe that the testing cost should have been absorbed by the, city ifthiq was communieauxl before I bid the project, I shouldn't matter if you test the dirt in place, or tes~ the dirt on the adjacent prolxa~y, lasting cost is testing cost no malter were it oceuxs_ It has been argued that if tho city kne~ about the testing cost, they would have not stockpiled on FHR's property, but our site does not have ~ny more room for strmkpile. I ' would assume that they would have required me to stockpile the dirt on the Fire Site, but that would have resulted in a change order to haul approx. 15,000 cubic y~rds of dirt at at. mx. $1.00 per yard_ This cost ofmovlno~ the dirt is much greater than the had purchase option. 1 would also like to note that the ex~a dirt stm:kpile wouldn't even be an issue if the LY'DAR had not been offby four feet, which was not mnsidered in our contra~t_ We did not charge thc city for excavating or moving the ~iditional yardage. However, all things been said, x~e would like t~ help put this issue to rest and continue on with the project. Our proposal is an offer of $5,000 approximately 50% of the land pUrchase price and to silt fence the dirt stockpile, wifich is a new requirement by Flint Hills. Please understand thai may not cover all cost asso~:iated with buying the land, but when th~ land is pu~cha-~ed, which was part of the master plan, The City of Corpus Christi will have full ownership of the land and the dirt stockpiled on it.
