HomeMy WebLinkAboutC2005-108 - 2/8/2005 - NA AMENDMENT No. 3 BARNEY DAVIS DEMONSTRATION DESALINATION PLANT CONTRACT FOR ENGINEERING SERVICES The City of Corpus Christi, Texas, hereinafter called "City", and Turner Collie & Braden Inc., hereinafter called "Consultant", hereby agree to the following amendment to the Contract for Engineering Services for the Barney Davis Demonstration Desalination Plant awarded by Mo[ion No. 2003-061, passed February 11,2003, amended by Motion 2003-393 on October 28, 2003, and administratively amended February 26, 2004: Section VII Ownership of Documents is amended to read: Vii. OWNERSHIP OF DOCUMENTS All documents including construction contract documents (plans and specifications), record drawings, contractor's field data, and submittal data shall upon payment of all fees and reimbursable expenses owed under this contract, be the joint property of the City and the Texas Water Development Board. It is mutually acknowledged that the Texas Water Development Board is not a party to this Contract and that the Texas Water Development Board has no liability under the terms of/his Contract Those documents may be used by the City Engineer for other City projects, and with the exception of standard details that are not specific to this project, may not be used again by the Consul[ant without the express written consent of the City Engineer. The City will assume sole liability for or arising out of any reuse or modification of the Consultant's documents, except where the Consultant is found to be liable by a court or forum of competent jurisdiction. The Consultant may retain copies of the construction contract, record documents, field data, reports, correspondence and working papers for its records. All other terms and conditions of the February 11, 2003 contract, as amended, between the City and Consultant will remain in full force and effect. CITY OF CORPUS CHRISTI TURNER COLLIE & BRADEN INC.
