HomeMy WebLinkAboutC2005-114 - 2/15/2005 - NACily of Corpus Christi DEPARTMENT OF ENGINEERING SERVICES PROPERTY AND LAND ACQUISITION DMSJON 7302Antelope St/Salt Flals 2AUETCE 2BUETCE Doc# 200500~ 1 ~7 Utility Easement THE STATE OF TEXAS COUNTY OF NUECES KNOW ALL BY THESE PRESENTS: THAT the HOUSING AUTHORITY of the City of Corpus Christi, (GRANTOR) of 3701 Ayers Street, Corpus Christi, Nueces County, Texas 78415, in consideration of $10 and other good and valuable consideration paid by the City of Corpus Christi, (GRANTEE) of 1201 Leopard Street, Nueces County, Texas 78469-9277, the receipt of which is hereby acknowledged, has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property description(s) attached and incorporated as Exhibits A and C. (Premises) Map(s) showing the location of the Utility Easement(s) TOGETHER WITH TEMPORARY CONSTRUCTION EASEMENTS are attached and incorporated as Exhibits B and D. The Temporary Construction Easements are further described as a 20- foot wide construction easement, south of and east of and adjacent to the permanent utility easements. Said temporary construction easements are to be used for working room and storage of materials and machinery during the construction phase. These Temporary Construction Easements automatically terminates upon completion and acceptance of the improvements of the Antelope Street and Salt Flats Area projec! by the City Manager of the City of Corpus Christi, Texas. SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore the land within the easement areas to the same condition as existed prior to construction of the pipeline. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility lines under, on and along said Premises. 2005-114 02/15/05 Housing Authority TO HAVE AND TO HOLD, ALL AND SINGULAR, the fights and privileges aforesaid to the City of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a UTILITY EASEMENT, TEMPORARY CONSTRUCTION and right-of-way for so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid fights and privileges cease.
