Temporary Construction Easement

KNOW ALL BY THESE PRESENTS:
THAT WE, Lee Barberito and wife, Dawn Barberito, hereinafter referred to as "GRANTORS"
of 11 Hewitt Drive, Corpus Christi, Nueces County, Texas 78404 for and in consideration of ONE
DOLLAR ($1.00), the receipt and sufficiency of which is hereby acknowledged to Grantor, in hand
paid by THE CITY OF CORPUS CHRIST1, a Texas Home Rule municipal corporation, its
successors and legal representatives, hereinafter referred to as "GRANTEE", of 1201 Leopard
Street, Nueccs County, Texas 78401, a TEMPORARY CONSTRUCTION EASEMENT for the
fi.cc and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along
certain tracts of land situated in Nueces County, Texas and being more particularly described as
follows:
A tract of land as shown on the attached map and
incorporated as Exhibit "A'.
'fhe Temporary Construction Easement is to be used solely tbr purposes necessary and related to
the construction of drainage improvements, including a construction staging area for the storage of
materials and machinery used during the construction phase. Grantee's right to the use of the
Temporary Construction Easemont shall automatically terminate upon the fmal completion and
acceptance of the Lindale/Chenoweth Subd. Area Drainage hnprovement project by the City
Manager of the City of Corpus Christi, Texas.
SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore
the land within the TEMPORARY CONSTRUCTION EASEMENT
AREA to the same condition as existed prior to construction of the
drainage improvements.
TO HAVE AND HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors and legal represematives for the use as a TEMPORARY
CONSTRUCTION EASEMENT and right-of-way/hr so long as used for such purposes, and
when the use of said easement is abandoned, then the aforesaid rights and privileges shall cease.
