WHEREAS, in 2005 the Corpus Christi Hooks Baseball Club will begin playing its home
games at Whataburger Field in Corpus Christi, Texas; and
WHEREAS, a component of the entertainment at such games will be a fireworks display
following certain of the home games; and
WHEREAS, the undersigned part~'g to this Memorandum of Understanding wish to set
forth a procedure for the fireworks display in relation to the Inner Harbor area of the Port of
Corpus Christi near Whataburger Field;
NOW, THEREFORE, the undersigned parties by the execution of this Memorandum of
Understanding acknowledge that they will follow the procedure for the fireworks displays at
Whataburger Field which is attached hereto as Exhibit A and incorporated herein by reference
for all purposes.

Safety Plan
to
Memorandum of Understanding
For Fireworks Displays At
Whataburger Field
Corpus Christi, TX
800-megahertz radio system operated by Metrocom (which radio system is here.~er
referred to as "Metrocom") will be used by all parties including:
Port of Corpus Christi Authority (HMO)
Corpus Christi Hooks Baseball Club (CCHBC)
Valero Marketing & Supply Company
Flint Hills Resources, LP
City of Corpus Christi
1395th Transportation Temfiaal Brigade
CCltBC will notify all parties via Metxocom 15 minutes prior to the estimated time of
the last out of the baseball game being played at Whataburger Field;
HMO will notify all vessel ~xaffic of the estimated time of the start of the fireworks
display;
The start of the fireworks display will be delayed until all moving vessel traffic has
cleared the area that may be affected; HMO will notify all parties when area is clear of
vessel traffic; and U. S. Coast Guard will authorize the fireworks display to start;

No cargo operations will be conducted at Oil Dock No. 1 or Oil Dock No_ 2 during the
fireworks display. Operators at Oil Dock No. 1 and Oil Dock No. 2 will be notified via
Melxocom 15 minutes prior to the estimated time of the last out in the baseball game
being played at Whataburger Field;
Operators at Oil Dock No.l and Oil Dock No. 2 will notify all parties via Metrocom
when all cargo operations are shutdown and secured prior to the fireworks display
starting;
All parties must, via Metrocom, vorbally agrec that all roquired measures have be~n taken
before the fireworks display can start;
No firework shells larger than five (5) inches in diameter shall be used for the fireworks
display~
1~I0 shall notify all parties of wind speed and direction prior to be~nning fireworks
display;
When winds exceed twenty (20) mph, shell size shall be reduced to four (4) inches in
diameter or three (3) inches in diameter dspendmg on wind speed and direction; the
decision as to the size shells to be used will be made by Pyrote~nleo of La, LLC and the
change in size of shell shall be confirmed by Pyrotecnico of La, LLC via Mcq~ocom;
All required Firework Display permits and insurance documents will be acquired by
CCltllC,qhjrotecni¢o of La,LLC.
The CCItBC will name the City of Corpus Christi, Port of Corpus Christi Authority,
Valero Corporation and Flint Hills Resources, LP as additional insureds on all its
applicable liability insurance policies;

13. An initial written Fireworks display plan will be developed by Pyrotecnico of Louisiana
and submitted to the State and City of Corpus Christi Fire Marshall's Offices;
14. A dress rehearsal shall be conducted with all parties participating, at least five (5) days
prior to the first scheduled fireworks display; and
15. All participating parties will meet within twenty-four (24) hours of the dress rehearsal to
discuss any and all problems arising arose during the rehearsal, and decide the action to
be taken to correct the problems discussed.
SPECIAL NOTE: Members of the 1395t~ Transportation Terminal Brigade have reviewed
the provisions of the Firework Display MOU and are satisfied that the provisions of the Safety
Plan are adequate to safeguard military equipment at the Port of Corpus Christi to the extent that
it may choose to curtail, delay and or, suspend ship cargo operations prior to and during all
Firework Displays. In addition, the 1395th is also satisfied that a City of Corpus Christi Fire
Truck and crew is adequate protection for military equipment staged in the vicinity.

The maximum length for each show is 12 minutes with the exception of the first, last and July 4th
games. The Maximum length for the three (3) noted games is 15 minutes.
