HomeMy WebLinkAboutC2005-129 - 3/18/2005 - NADo¢~ 2005014185l I~t of Engi~ Services I~ and L~nd Acaluisi~io~ Divismo 7326 Williams Drive W~' Rehab Temporary Construction Easement THE STATE OF TEXAS § COUNTY OF NUECES § KNOW ALL BY THESE PRESENTS: THAT Gulfway Limited Partnership, a Texas Limited Partnership (Grantor) of 9200 Keystone Crossing, Suite 500, Indianapolis, Marion County, indiana 46240-7602 in consideration of $10 and other good and valuable consideration paid by the City of Corpus Christi (Grantee), Nueces County, Texas, 78469-9277, the receipt of which is hereby acknowledged, has conveyed, and does convey unto the City of Corpus Christi, Texas, a Texas Home Rule municipal corporation, its successors and legal representatives, the fi:ce and uninterrupted nsc, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land s~tuated in Nueces County, Texas, and being described as follows: See the metes and bounds property description attached and incorporated as "Exhibit A". ("Premises") A map showing the location of the Temporary Construction Easement is attached and incorporated as "Exhibit B". This Temporary Construction Easement is to be used for working room and storage of materials and machinery during the construction phase. This Temporary Construction Easement automatically terminates within Twelve (12) months from the recording date of this easement or upon completion and acceptance of the improvements of the Williams Drive Wastewater Trunk Main Manhole Rehabilitation project by the City Manager of the City of Corpus Christi, Texas, whichever occurs first. SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore the land within the temporary construction easement to the same condition as existed prior to construction. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, for the purpose of the rehabilitation and replacement of a sanitary sewer manhole, adjacent to the Premises.
