O. Box 9277, Nueces County, Texas 78469-9277. a FIFTY-TWO FOOT (52') WIDE PERMANENT UTILITY EASEMENT to construct, maintain, service, operate, repair, remove and replace public utility lines ("Utilities") under, across and through certain tracts of land situated in Nueces County, Texas and being more particularly described as follows: Being a 0.057 acres (2,496 square feet) of land, more or less, out of Lot 3, Block I, Kings Crossing Unit 1, Phase 3, as recorded in Volume 51, Page 143, Map Records of Nueces County, Texas and being more particularly described by metes and bounds on the attached and incorporated as Exhibit "A' and shown on a map attached and incorporated as Exhibit "C'. TOGETHER with a TEMPORARY CONSTRUCTION EASEMENT located immediately West of and adjacent to the Permanent Utility Easement as shown on Exhibit "B'. SPECIAL PROVISIONS: I. Landscaoing: Grantee agrees lo create a linear boundary west of and adjoining the new permanent utility easement and lift station site. Grantee agrees to install a non-corrosive "edge strip" that runs north from the northwest corner of the permanent utility easement, then dissecting the northwest corner of the lift station site and terminating at the south boundary of the adjoining AEP Substation property. The two triangular spaces that will be created by the diagonal "edge strip" will be prepared with weed-retardant landscape fabric, then filled with crushed limestone. 2005-185 03/31/05 (;race Presbyterian Church 2. Driveway: A barricade will be placed at the end of the liR station access driveway for the purpose of preventing motorists from driving beyond the end of said driveway. A non- corrosive support strip will be used for the paver stone walkway to be constructed along the south edge of the access driveway. 3. Screening: Grantee agrees to place slats within the bars of the lift station entrance gates for the purpose of decorative screening. 4. Terms of the Temporary Construction Easement: The Temporary Construction Easement is to be used solely for purposes necessary and related to the construction of the improvements within the Permanent Utility Easement and Lift Station Site, including a construction staging area for the storage of materials and machinery used during the construction phase. Grantee's right to the use of the Temporary Construction Easement shall automatically terminate upon final completion and acceptance of the improvements of the wastewater lift station project by the City Manager of the City of Corpus Christi, Texas. 5. Cleanup and Restoration: Grantee expressly agrees that it will remove from said land all surplus material and will cause said land to be left as nearly as possible in its condition as it existed prior to the construction of said improvements. Grantee shall have the right of free ingress and egress over and along said Permanent Utility Easement to construct, service, repair, maintain, inspect, operate and remove said Utilities. TO HAVE AND TO HOLD, ALL AND SINGULAR, the fights and privileges aforesaid to the City of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a PERMANENT UTILITY EASEMENT and right-of-way for so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights and privileges cease.
