O. Box 271201, Corpus Christi, Nueces County, Texas 78427 in consideration of ONE DOLLAR (,$l) and other good and valuable consideration prod by the City of Corpus Christi, 1201 Leopard Street, Nueces County, Texas 78469-9277, the receipt of which is hereby acknowledged, have conveyed, and do convey to thc City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the flee and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See the metes and bounds property descriptions for the Utility. Easement attached and incorporated as Exhibit A. A map showing the location of the Utility Easement (shaded) is attached and incorporated as Exhibit B. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility lines under, on and along said easement. TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors, legal representatives, and f~anchisees for the use as a UTILITY EASEMENT and right-of-way for so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights and privileges cease. This Utility Easement is made in place of and to correct a Utility Easement executed by Grantor herein to Grantee, dated June 28, 2004 and recorded in Document No. 2004031313, Deed Records, Nueces County, Texas, wherein by error, the location of the additional five foot width which accommodates a casing, was Incorrectly described and shown in the exhibits attached to the previously recorded Utility Easement. Parcel 14 #7117 Buckingham L.S./F.M.D. FIELD NOTES to describe the boundary of a variable width utility easement across a tract of land described in a deed to ONAC DEVELOPERS, INC. as recorded in Document #2003059364, Official Records, Nueces County, Texas, said variable width easement being more particularly described by metes and bounds as follows; BEGINNING at a 5/8" steel rod set in the north line of a tract of land described in a deed to Corpus Christi Independent School District as recorded in Documents #532227 through #532231, Official Records, Nueces County, Texas and the south line of said ONAC DEVELOPERS, INC. ~act for the southeast comer of this easement fi.om which the southeast comer of said ONAC tract bears S-61°-23'-20"-E, 30.00'; THENCE, N-61°-23'-20"-W, at 5.00' pass the northwest comer of said C.C.I.S.D. tract and the northeast comer of a tract &land described in a deed to Hogan Development Co. L.P. as recorded in Document #2003024401, Official Records, Nueces County, Texas, in all a distance of 15.00' to a 5/8" steel rod set for the southwest comer of this easement; THENCE, N-28°-36'-40"-E, a distance of 20.00' to a 5/8" steel rod set for an exterior comer of this tract; TltENCE, S-61°-23 '-20"-E, a distance of 7.50' to a 5/8" steel rod set for an interior comer of this tract; THENCE, N-28°-36'-40"-E, a distance of 2355.05' to a 5/8" steel rod set in the south line of a tract of land described in a deed to Bmselton Properties as recorded in Document #2000011494, Official Records, Nueces County, Texas for the northwest comer of this easement; THENCE, S-61°-23'-20"-E, a distance of 7.50' to a 5/8" steel rod set for the northeast comer of this easement; THENCE, S-28°-36'-40'-W, a distance of 305.44' to a 5/8" steel rod set for an interior comer of this easement; THENCE, S41°-23'-20"-E, a distance of 5.00' to a 5/8' steel rod set for an exterior comer of this easement; THENCE, S-28°-36'-40"-W, a distance of 200.00' to a 5/8" steel rod set for an exterior comer of this easement; THENCE, N-61 °-23'-20"-W, a distance of S.00' to a 5/8" steel rod set for an interior comer of this easement; THENCE, S-28°-36'-40"-W, a distance of 1869.62' to the POINT OF BEGINNING and containing 18,965 square feet (0.4353 acres) of land, more or less.
