KNOW ALL BY THESE PRESENTS:
THAT I, Daniel J. Kubala and wife, Irene Kubala (GRANTORS) of4018 Bahama Drive, Corpus
Christi, Nueces County, Texas 78411 in consideration of ONE DOLLAR ($1.00) and other good
and valuable consideration paid by the City of Corpus Christi, (GRANTEE) of 1201 Leopard
Street, Nueces County, Texas 78401, the receipt of which is hereby acknowledged, have conveyed,
and do convey to the City of Corpus Christi, a Texas Home Rule murdcipal corporation, its
successors and legal representatives, the fi'ee and uninterrupted use, liberty, privilege, and easement
of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and
being described as follows:
See the metes and bounds property description for the utility easement
attached and incorporated as "Exhibit A".
Map (crosshatched) showing the location of the Utility Easement
TOGETHER with a Temporary Construction Easement is attached and
incorporated as "Exhibit B".
The Temporary Construction Easement is further described as a 25 foot
wide construction easement, north of and adjacent to the permanent utility
easement. Said temporary construction easement is to be used for working
room and storage of materials and machinew during the constmcfionphase.
Tiffs Temporary Construction Easement automatically terminates upon
completion and acceptance of the improvements of the Saratoga Utihty
lmprovements/SH-2g6-Greenwood-2005 project By the City Manager of the
City of Corpus Christi, Texas, or his designee.
SPECIAL PROVISIONS: The City of Corpus Christi agrees to restore the land
within the easement areas to the same condition as existed prior to construction of the
pipeline(s).

Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and
its franchisees to construct, service, repair, maintain, inspect, lay, operate and keep public utility
lincs under, on and along said easement.
TO HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a
UTILITY EASEMENT, TEMPORARY CONSTRUCTION EASEMENT and right-of-way for
so long as used for such purpose, and if the use of said easement and fight of way is ever
abandoned, then the aforesaid rights and privileges cease.

BEING OUT OF THAT CERTAIN 96.32 ACRE TRACT OF LAND, DESCRIBED IN

BEGINNING, at a point on the north right-of-way Line of that certain roadway (120.0 feet
wide), known as Saratoga Boulevard (SH 357), at ils intersection with the west boundary line of
Lot 1, Block 1, Saratoga place, a map of whlch is recorded in Volume 27, Page 93, of the Map
Records of Nueces County, Texas;
Thence, North 61° 51' 20" West, with said north right-of-way line of Saratoga Boulevard (SH
357), a distance of 219.95 feet, to a point, for the soulhwest comer of this tract, same point being
the southwest comer &said 96.32 acre tract of land;
Thence, North 28° 38' 40" East, with the west boundary line of said 96.32 acre tract of land,
same line being the east bounda,D' line of Lot 5, Block 1, Saratoga Place, a map of which is
recorded in Volume 46, Page 194, of the Map Records of Nueces County, Texas, at 0.55 feet,
pass a 5/8 inch iron rod, found, in all a distance of 30.00 feet, to a pont, for the northwest corner
