KNOW ALL BY THESE PRESENTS:
THAT I, Marie Clarke, (GRANTOR) of4110 Lowman, Corpus Christi, Nueees County, Texas
78411 in consideration of One Dollar ($1.00) paid by the City of Corpus Christi, (GRANTEE)
1201 Leopard Street, Nueees County, Texas 78469-9277, the receipt of which is hereby
acknowledged, have conveyed, and do convey to the City of Corpus Christi, a Texas Home Rule
municipal corporation, its successors and legal representatives, the free and uninterrupted use,
liberty, privilege, and easement of going in, on, over, under and along a certain tract of land
situated in Nueces County, Texas and being described as follows:
See the metes and bounds property description attached and incorporated as
"Exhibit A' (Premises).
Map showing the location of the Utility Easement TOGETHER WITH A
TEMPORARY CONSTRUCTION EASEMENT is attached and
incorporated as "Exhibit B".
The Temporary Construction Easements is further described as a 25 foot
wide construction easement, north of and adjacent to the permanent utility
easement. Said temporary construction easement ~s to be used for working
room and storage of materials and machinery during the consm-uction phase.
The Temporary Construction Easement automatically terminates upon
completion and acceptance of the improvements of the SARATOGA
UTILITY IMPROVEMENTS project by the City Manager of the City of
Corpus Christi, Texas.

SPECIAL PROVISIONS: 1. The City of Corpus Christi agrees to restore the land
within the easement areas to the same condition as existed prior to construction.
2. The City of Corpus Christi agrees to connect Grantor's existing water service line
to the new 12 inch waterline. 3. The location of the tap for the 12 inch sanitary sewer
line will be determined in the field by the Grantor and the contractor. Grantor will be
responsible for all Development Service fees required for Grantor's connection to the
instafled wastewater tap.
1'O HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a
UTILITY EASEMENT and right-of-way for so long as used for such purpose, and if the use of
said easement and right of way is ever abandoned, then the aforesaid rights and privileges cease.

CERTAIN 2.0 ACRE TRACT OF LAND, DESCRIBED IN VOLUME 1782, PAGE 313,
DEED RECORDS OF NUECES COUNTY, TEXAS AND BEING OUT OF LOT 5,
SECTION 7, BOHEMIAN COLONY LANDS, A MAP OF WHICH IS RECORDED IN
VOLUME A, PAGE 48, OF THE MAP RECORDS OF NUECES COUNTY, TEXAS,
THIS TRACT BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS;
Bearings are derived ~om Global Positioning System observations, based on the Texas
Coordinate System, NAD '83, South Zone (4205) and referenced to the monumented north right-
of-way line of Saratoga Boulevard (State Highway No. 357).
BEGINNING, at a point on the north right-of-way line of that certain roadway (120.0 feet
wide), known as Saratoga Boulevard (SH 357), at its intersection with the west boundary line of
said 2.0 acre tract of land, same line being the east boundary line of Lot 1, Block 2, Saratoga
Place, a~ shown on map recorded in Volume 27, Page 93, of the Map Records of Nueces County,
Texas, for the southwest comer of this tract, fi.om which point, a 3/8 inch iron rod, found, bears
South 00° 19' 20" East, a distance of 0.35 feet;
Thence, North 28° 38' 40" East, with above described common boundary line of Lot 1 Block 2
and 2.0 acre tract of land, a distance of 30.00 feet, to a point, for the northwest comer of this
tract;
Thence, South 61 ° 51' 20" East, a distance of 165.00 feet, to a point, on the east boundary line of
said 2.0 acre tract of land, same line being the west boundary line of Block 4, Saratoga Place, a
map of which is recorded in Volume 28, Page 16, of the Map Records of Nueces County, Texas,
for the northeast comer of this tract;
Thence, South 28° 38' 40" West, with above described common boundary line of Block 4,
Saratoga Place and 2.0 acre tract of land, a distance of 30.00 feet, to a point on aforementioned
north right-of-way line of Saratoga Boulevard (SH 357), for the southeast corner of this tract;
Thence, North 61° 51' 20" West, with said north right-of-way line of Saratoga Boulevard (SH
357), same line being the south line of said 2.0 acre tract of land, a distance of 165.00 feet, to the
