Map showing the location of the Utility Easement TOGETHER WITH A TEMPORARY CONSTRUCTION EASEMENT is attached and incorporated as "Exhibit B". The Temporary Construction Easements is further described as a 25 foot wide construction easement, north of and adjacent to the permanent utility easement. Said temporary construction easement ~s to be used for working room and storage of materials and machinery during the consm-uction phase. The Temporary Construction Easement automatically terminates upon completion and acceptance of the improvements of the SARATOGA UTILITY IMPROVEMENTS project by the City Manager of the City of Corpus Christi, Texas. 2005-215 05/17/05 qT~733 I Sm-atoga Utility Imp. Clarke RSdoc Clarke, Marie SPECIAL PROVISIONS: 1. The City of Corpus Christi agrees to restore the land within the easement areas to the same condition as existed prior to construction. 2. The City of Corpus Christi agrees to connect Grantor's existing water service line to the new 12 inch waterline. 3. The location of the tap for the 12 inch sanitary sewer line will be determined in the field by the Grantor and the contractor. Grantor will be responsible for all Development Service fees required for Grantor's connection to the instafled wastewater tap. 1'O HAVE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a UTILITY EASEMENT and right-of-way for so long as used for such purpose, and if the use of said easement and right of way is ever abandoned, then the aforesaid rights and privileges cease.
