2. SCOPE OF SERVICES
The Consultant Engineer hereby agrees, at its ovm expense, to perform deaign aervicea
necessary to review and prepare plans, specifications, ,,nd bid and contract documents. In
addition, Cormultant Engineer will provide rnonthly ~Lus updates (pra~at progress or delays,
Gantt charts prmented with mo,,IJ,ly Invoice~) and provide contract administration se~vicee, as
deecnbed in Exhibit A to complete the Project. Work will not begin on Addltlorml Servlcea
until requested by the Consultant Engineer (provide breala:low~ of costs, schedules), mid
w,i~'u~n authodzat~n Is provided by the Director of Engineering Services.
Consultant Engineer services will be "Services for Construction Pm'ject~"- (Beak= ~ for
ConstnJ~on Projects") which are shown and are in accordance with 'Pmfeaak)nal
Engineering Services- A Guide to the SeleclJon and Negotiation P~, 1993" a Joint
publication of the Cormul'dng Engineer's Council of Texas and Texas Society of Profeeeional
Engineers. For purposes of this co. bact, certain aervice~ II~ted In tht. publication aa
Additional Services will be considered as Basic Sefvicee. The summary of these tasks and
services are listed in Exhibit A.
3 ORDER OF SERVICES
The Cormultant Engineer agrees to begin work on those authorized Basic Sef~cea for thle

Services. The anticipated achedule of ~ pml~ninmy phase, deelgn phase, bid phase, and
cormtruclJon phase ia ahow~ on Exhibit A. This achedule Is not to be Inclusive of all
additional time t~at may be required for revtew by the City staff and may be amended by or
w;tl, the concurrence of the Director of Engineering Services.
The Director of Engineering Services may direct rite Cormurmnt Engineer to undertake
additional servfcea or taa~ provided lttat no increase In fee la required. Se~tces or taaka
requinng an increase of fee will be mutually agreed and evidenced In writing aa an
amendment to this contract. Consu~nt Enginee~ shall nolffy rite City of Corpua Chrbti wtlttln
three (3) clay~ of notice If taaka requeated require an additional fee.
4. MANDATORY REQUIREMENTS
Consultant Engineer agreee to the mandatory contract and Insurance requlrernen'm aa aet
forth in F. xhl~t B.
5. FEE
The City will pay the Consultant Engineer a fee, as deacrlbed in Exhibit A, for provkllng
services authorized. Monthly invoices will be submitted In accordance with Exhll~t O.
§. TERMINATION OF CONTRACT
The C~ may, at any time, with or wtt~ut cause, te~nir~e ~la co,-,b.ct upon ,even days
Consultant Engineer will be compermated for i'm ~ on all stagea aulfxxtzed ~ upon
Consultant Engineer- and City's estimate of fl~e proportion of the total aervicee actually
complebad at the time of termination.
7. ASSIGNABILITY
The Consultant Engineer will not aaaign, transfer or delegate any of rm obllgatk)rm or dutlea In
routine du'de~ delega~:l to pe~onnel of rite Cormultant Engineer ~;,-~. If the Consultant
Engineer is - partnership, then in the event of the termination oflhe partnemhlp, fl~b contract
will i~um to the Individual benefit of such parlner or partners aa the City may deaignate. No
part of the Consultant Engineer fee may be assigned In advance of receipt by ~e Consultant
Engineer ~ wfll~n consent of ff~e City.
The City will not pay the feee of expert or technical assl~nce and cormultanls unlees such
employment, Including the ,-a'~e of compensation, has been approved In writing by ~ City.
8. OWI~IERSHIP OF DOCUMENTS
All doc~rnents including co. bact docurnen'~ (pierre and spedfl(mt]o~), record drawings,
contractor's field da;,-, and submittal da;.. will be ~e sole ~ of rite City, may not be
used again by rite Consultant Engineer wtltx)ut the express written conae~ of the Director of
Engineering Services. However, the Conaultant Englnee~ may uae standard delalls fi'tat am
not specific to this proJecL The City agrees that any modification of the pierre will be
evidenced on ~ plans, and be signed and sealed by a ~1 engineer prior to re-uae
of modified plans. Consultant Engineer shall not be reapona~31e for any Ilabllttlee resulting
from ~uc~ modification.

2. Provide a pdva~ I~ 900 MHz wireleaa radii link between Wesley E. Seels
Dam and the ~-w water I.~,ke sitaa along the Neucaa River via a repeab~ site at
O.N. Stevens WTP. The link will include SC, ADA communication improvements
consisting of an ard~nna, cabling, and grounding acceaaorlaa at the O.N.
~ WTP and Waaley E. Seals Dam. Communlca'don Improvements will be
provkJed by High Man Tower aa a subconsultant to FNI. ProvUe radio
tmrmcaivera/mpeaters for Waa~ey E. Seals Dam, O.N. Stevona VVTP, and the
five (5) raw water intake sitaa along the Nuece, River. Commlsaiinlng and
testing of the radii link will be provklecl In conjunction w~ Automated concepts,
Inc. aa a subconsultant to FNI. The new link will be entirely Independent of the
tek,Tmtry link will also be used for remc,~, operation and status monitoring of the

6 Provide 8 new h'~:~mfdon ~er at tf~e Weeley E. Scale Dam Operations
Center to serve ~e raw water monitoring system and t~he RJncon Bayou Pipeine
supervtaory control system. The I~formation sewer will be placed In the existing
Security and Surveillance Equipment Rac~ and replace an endstlng outdated
information server. Configu~u~n and commiaaionlng of the Info,,,atlon server
will be provided in conjuncUon ~ Automa~ Concept~, Inc. (ACl) aa a
subconsul'mnt to FNI.
