InspeclJon is not and should not be constnJed to be a warranty by "LAB" to ttm "CITY' or any other party Samples collec~d or tested by "LAB" rernak~ the property of the "CRY" while in the custody of the "LAB". "LAB" will re~ln the samples for a period of 60 days following the da~e of submission of any report related to the sample. Following the retention berlod, "LAB" will dispose of non-haza~ua samplas, and return hazardous, acutely toxic, or mdioactfve samplee and samples containers and residues to "CITY". "CITY" agreee to accept such samplsa and samples containers. STANDARD OF CARE AND WARRANTY Servtcea performed by "LAB" will be conducted in a manner conaJatent with that level of cam and skill ordinarily exercised by reputable members of the profas~ion ctJrrently practicing under similar conditions in the same locality. No other warranty either expresm~ or implied ia made or Intended by the AGREEMENT or any reports. "LAB" will not be re~<m~ble for the interpretation or use by ob~ers of data developed by "LAB'. "CITY" and "LAB" agree b%at, in accordance with the generally accep~d const]'uction practica, the PROJ EC'I'I'IS general con[,actor will be solely and completely responsible for working conditions on THE PROJECT, Including safety of all persons and property during the performance of lyre work, and for compliance ~ all municipal, s~k~, and federal law~, rulee and regulations, including OSHA. The duty Of"LAB" in providk'tg services ia not, therefore, to inciude any review of, or responsibility for, the adequacy of the PROJECT'S general contractor's safety measures in, on, or near THE PROJECT site. EXTENT OF AGREEMENT This AGREEMENT, including Exhibit "A" and these terms and conditions, represents the entire AGREEMENT between 'CITY" and "LAB' and supersedes all prior negotiation, representations or agreemente, w~-~u~n or omi. This AGREEMENT may be amended only by a written Instrument signed by duly authorized represe.;,.[;ve of 'CITY" and "LAB". ff any conflict occam between these terma and conditions and this AGREEMENT, these terms and conditions am controlling. In the event that any one or more of the prov~iona coi~lned in this AGREEMENT are for any mason held invalid, illegal or uneaforceable In any respect, the remaining terms will be in full effect and ~is AGREEMENT wfl be coe~trued as If th~ invalid or une,~forceab~e mattem were never Inctuded in this AGREEMENT. No waiver of any default will be a waiver of any future default.
