Box 9277, Corpus Christi, Texas, 78489-9277, and Brigh'mn Park Bapt~t Church, ('Developer'). WHEREAS, Developer in compliance with ttm City Piattlng Ordinance, has flied a ~ to develop a tract of land of approxkna~ely 7.06 acres ca~cl lot I of Brighton Park Baptist Church, located o~ the east side of AJdlne Road, south of Brooke Road, as show~ In the attached Exhibit 1. WHEREAS, the City's Water Distribut~n Master Ptan, 1997, requires the con~tnx:tkm of a 12-inch PVC arterial bansmisaion grid main in order for ~ 1 of Brighton Park~ Church to have water servtce; and WHEREAS, under ~ Platting Ordinance, the Developer Is responsible for construction of a 12-Inch PVC arterial tmrtsrnlaalon and grid main; and WHEREAS, under the Platting Ordinance, the Developer Is eligible for reimbursement of the Developer's cosls for the construction of a 12-inch PVC arl~'ial l]'anemissk)n and grid main; and WHEREAS, it is essential that the 12-inch PVC arterial tranamisMon and grid main be constructed along Airline Road in cormectk)n with Wot 1 of Brlghk;,n Park Baptist ~ for it will provide futura service connections to the south of L~ 1 of Brighton Park Baptist Church; and WHEREAS, it Is to the best Interest of the City and the Developer for the 12-Inch PVC arterial tmnsmiaalon and grid main be commucted to the size and serve the area specified in the Water Dl~blbution Master Plan. 1997; NOW, THEREFORE, for and in ccmsiderafion of the mutual covenants in this Agreement, the parties do covenant and agree aa follows: 1 REQUIRED CONSTRUCTION The Developer shall consatmt ~ 12-inch PVC arterial tran~nlsslon and grid main needed for Lot I of Brigl'~n Park Baptist Church in compliance with ~ city's Platting Ordinance and under ~ plans and specifications approved by the City Engineer. The Developer st~all contract w~[~% a professional engineer, eccep<able to b~e cvs Dlrec~r of Engineering Services, to prepare plans and s~ for the 12-inch PVC arterial b'ansmisak)n and grid main, as ehow~ in ExhlMt 2, with b~m following basic design: (1) Ins[all 640 linear feet of 12-Inch PVC ITansmlesion/grid main. (2) Ins[all 1 (o~e) Fire I--lydmnt Assembly In-place. (3) Ins[all 2 (two) 12-inch Gate Valve and Box. (4) Install I (one) 12-irtch Cap with Blow-off Valve and Riser. (5) Ins[all 1 (one) Connect to existing waterline. (6) Install 78 (seventy-eight) square yard Pavement Repair. (7) Ins[all 1 (one) 12'x12'xS' Ductile Iro~ Tee. (8) Install 20 linear feet of 24-inch Steet Casing. (9) Irmtell 70 linear feet of 12-Inch Ductile Iron Pipe. (10) Ir~all 4 (four) Ductile line 45 degree bend (mechanical Joint) (11) In~all 2 (two) Mechanical Joint Rasl~alnt Flffing Road from the existing 12-inch water line previously Installed by others and extend to approximately the south boundary of Lot I of Brighton Park Baptist Church. b. The p4ans and specifications must compiy w~ City Standard Water Detal Sheets and Standard Specifications. c. Before the Developer e[arts conab~ the p~ans and apeciflcatfcm must be approved by the City's Dh'ector of Engineering Services. 3. SITE IMPROVEMENTS Prior to conetruction of the 12-inch PVC arterial I~armmiesion and grid main, the Derek)per ,haJI acquire and dedicate to ~ City the required u'dlity easement or right-of- way for the installatioe of the 12-1nch PVC arterial tmnemlasion and grid main. 4. PLATI'ING FEES. Developer shall pay to the City of Corpus Christi the requked acrmage fees and pro-rata fees as required by the Piatflng Ordinance. 2of5 5 DEVELOPER AWARD CONTRACT FOR IMPROVEMENTS. Developer shall award a co,buct and complete the 12-inch artedal tnansmission and grid main, In accordance w~th the approved plans and specificat~, by August 31, 2006. 6 REIMBURSEMENT. a. The City will reimburse the Developer 100% oft)he cost of the 12-inch PVC arterial transmission and grid main, not to excc~l $47,146.28 within 30 days upon Invoicing by the Developer, if the work has been completed, inspected and accot~ed by the City. The City agrees to corKJuct periodic inspeclJons of the progress of the work at key points during the co~s'~uction. b. The City will reimburse the Developer for expenses incurred for the preparation of plans and specifications for the 12-inch PVC arterial bansmisslon and grid main by the professional engineer hired by the Developer. However, the expenses may not exceed 7 5% of the costs of construction of the 12-inch water grid main.
