Owner must acquire and maintain commercial general liability Insurance parlalning to the Use Privilege improvements and the activities related b3 the Uae Privilege Impmvernents authorized by this Agreement, in the minimum amounts set forth In the attached and Incorporated Exhibit B. The General Liability policy must name the City as N3dltional Insured. Upon City Manager's written request, Owne~ shall provide a3pk~ oi' all .nsurance policies to the Ctty Attomey. Such policies may not be canceled, renewS, or materially changed without 10 days advance written notice to the City's Director of Development Services. or designee ('Asst. Director of Development Services'). D. Owner's uae of the Use Privilege Improvements must no~ Interfere w~ City's construction, operation, repair, replacement, or maintenance of any existing or futura oeopoesd sidewalks, utility lines, or otYmr uses. If City (or any off'mr franchisee wflh ufllltias currentiy located In said rlghts-of..way) neede access to the rights-of-way, Owrmr must pay for mrnoving or ralocabng the Use Privilege Improvements to allow ecceae to the utility lines fo~ repair, replacement, or maintenance of the utility lines. The Owner must mpalr the Jse Prvilege Improvements to their original condition or remove the Uae Prlv~ge Improvements at which time this Agreement terminates Immediately. E. Owner must not c~oes or barricade a public street, or any porlJon of the pubic ~ uet, to ~nstell, repair, or maintain the Use Privilege Improvements until lyre Pmmlttee or Ids conbactor has filed an approved traffic control plan with City's Traffic Engineering Office. Owner must pay to maintain or repair rite Uae Privilege Improvements at ali times, regardless of the type of damage that may occur, within 30 calendar days ol' notice of damage to Permittee Failure to do so terminates this Use PrMlege Agreement G. Owner ~s responsible for maintaining all the milroed rolling (timber grille and pm-fab concrete grade) crossings on both the Sam Rankln St. and N. Tencahua Sleet rights-of- I:~ge 2 o~ 6 H. Owner is responsJble for IXoviding and maintaining all necessary advance wamlng railroad crossing signs and equipment within both Itm Sam Rankln and N. Tarr~hua Slmet rlgh'a-of-way, as per aPlXOved plans and any subsequent revisions. I, Owner must comply wtlh all applicable Federal, State, and local laws and regulations, as may be amended. J.
