WH~R~A~, Developer has applied for the closure of 3'~ Street and oblained
approval (Ordinance No. (126403, approved by Council August 23, 2005), and is
c(ms~'ucting public street, aiu, mwater, w~'tew~ter, and w~ter improvem~'m aa part of
the plans to reroute the existing 3'~ Street tnd~ie(Exldblt
WHEREAS, the Developer has submitted construction p!ar~ that show the extent
of l J lC ~mprovenl~ntlt;
WHEREAS, it is in the best interests of the City to have curb and gutter,
s,dewalka, stormwater improvements, and waatewater improvemema ixmalled by the
Dtwcloper in conjunction with thc Developer's project;
NOW, TFIEREFORE, in order to provide a coordinated street eonalna~on
project, the City and Developer agree as follows:

inoluding m~o and gutte~, sidewalls, stozmw~ter and w~c~tam- impmv~nea~ along
Sama Fe ~ E~ StreW. The in~,, rovements a~e m~u/red to be cee~au~d.__ in

Agreemem will be null and void if the City determin~ timt the impmvomem~ m'~ not
consu'uct~l in ig~rdan~ with the apl:reaved phns and sp~ifio~tiona. The
wdl then be contr~t~ foe and financed completely by the Developer.
The total cost of the City's Stuu'e ot' public improvements, us depicted on in (Exklblt 2)
ia $33q,965.00.
The City ahall reimburse the Developer for the City's share of public im?rovemm:~ for
thll development in the following manner:
Upon final acceptance of the public improvements by the City Rn~neer, the
Developer will be paid for a~-ttml cos~ of the City's abate, not to exceed
$339,965.00, of the required public improvements no I~ tium sixty (60)
