HomeMy WebLinkAboutC2005-652 - 11/29/2005 - NAThis A~reemant (the 'A~reement') is made between ;tlfonso Benavides, o~ner of house located at 147 Wellwood Drive Corpus Christi, Tens, 78410 ('HOUSING P~f)VIDER'), a Texas cor~moration, and the City of Corpus Christi, Texas (the ACity~), a munici~al corporation. NHERF~%S, on September 2, 2005, the Office of the Governor requested Corpus Christi's assistance to provide shelt6r to assist a~roz~mmtely 3,000 people who were displaced as a result of Hurricane Katrina (~evacuees'); ~BY_J%S, approz~mmtel¥ 400 evacuees rae~in housed in Corpus Christi shelters; #HERE~2, the evacuees require housing; 2. Res~onsibilities of the HOUSING PROVIDER. A. HOUSING PROVIDER shall provide housing, and to the extent ~ssible, provide furniture and utilities to evacuees. B. HOUSING PROVIDER may charge for'deposit for evacuee housing that is equivalent to the usual and custom~ry amount charged other lessees. C. HOUSING PROVIDER shall bill the City monthly evacuee housing costs which are dee~ allowable for reimbursement by ~EMA. D. The HOUSING PROVIDER agrees to record its expenditures under this A~reement on a regular basis. The HOUSING PROVIDER agrees to provide the City with a copy of the HOUSING PROVIDER expenditures and supporting doc-m~nts on a weekly basis. E. The HOUSING PPJ3VIDER agrees and acknowledges that the City shall only reimburse the HOUSING PROVIDER's costs if such costs are deemed reimbursable by FEMA. The HOUSING PROVIDER shall be responsible for all costs which are not reimbursed to City by FEMA. E. HOUSING PROVIDER agrees to provide City with at least 60 days advance written notice prior to initiating any att-m?t to remove any evacuee fro~ housing to allow City sufficient t4me to either negotiate solution with HOUSING PROVIDER or obtain alternative housing for evacuee. t~. ?he Housing Provider shall offer housing services at ~ates equivalent to other lessor rates in the same complex. If any portion of this Agreement, or its application to any person or circ,~-tance, shall ever be held to be invalid or unconstitutional by any court of co-~.etent jurisdiction, the r~-inder of this Agreement shall not be affected and shall continue to be enforceable in accordance with its tek.--. 13. N(~k~ Any notice, correspondence or payment made pursuant to this Agreement must be made by (a) depositing the same in the United States mail, postage prepaid, addressed as follows, or (b) delivering the s~m~ to the othe~ Party.
