HomeMy WebLinkAboutC2005-684 - 12/8/2005 - NA AGREEMENT CONCERNING PAYMENT OF FUNDS IN SUPPORT OF Asian Cultures Museum and Educational Center The City of Corpus Christi (the "City") and the Billie Trimble Chandler Arts Foundation, Inc dba Asian Cultures Museum and Educational Center (the "Museum") make this Agreement concerning payment of funds in support of the education and cultural development programs provided by Museum provided by the Museum (the "Programs") and acknowledge: 1 The Museum has provided the citizens of Corpus Christi with educational and cultural Programs regarding the Asian cultures. This is accomplished through outreach programs to schools, recreation centers and day care facilities. The Museum also provides a teacher and teaching aides for field trips to the Museum and class room use. The Museum also cooperates with the Sister City Program and sponsors cultural events through Japanese and Chinese Embassies. 2 The City supports the Center and wishes to assist in its funding for the period August 1, 2005 through July 31, 2006. The City and the Center agree: 1 The City will pay the Center Fifteen Thousand dollars ($15,000) to support the Programs, for the 2005-2006 budget year, to be paid out on a quarterly basis based upon the City's Fiscal Year. The payments may be adjusted by the City Manager, or his designee ("City Manager"). The payments will be made upon receipt of invoices and documentation of receipt of services and payments made by the Museum relating to the Programs during each quarter, including without limitation operational costs such as salaries and utilities. Invoices and the backup documentation shall be sent to the Park & Recreation Department, Cultural Services Division, P. O. Box 9277, Corpus Christi, Texas 2 In consideration of this payment, the Museum shall: a Continue to preserve and maintain the artifacts and exhibits of the Museum; b Maintain hours during which the Museum is open to the general public; C. Continue outreach programs to school, recreation centers, and day care center; d. Make the facility available to school field trips and provide a teacher and a program for such field trips within the resource capacity of the Museum; e Make teaching aides available to teachers for class room use within the resource capacity of the Museum; f Cooperate with the Sister City and other City Programs; g. Allow the City to review the books and records of the Museum to monitor the disDosition of the funds paid under this Agreement. The City and the Museum also agree that: a. The City Manager shall determine the date and frequency of payments by the City to Museum in support of the Program in any future years if and when such funding is appropriated by the City Council. Such payments will be made on a quarterly basis, but may be made more or less frequently as solely determined by the City Manager; b, The City Manager shall have the authority to defer, suspend or cancel any payments to Museum should any audit or other source of information indicate that any City funds have been applied to uses other than those herein stated without the express and prior written approval of the City Manager, or his designee; c. Payments shall not be used in any manner contrary to law or this Agreement; d This Agreement may be amended at any time by written agreement of the City and Museum e.
