MODIFICATION TO AN AGREED ORDER
TCEQ DOCKET NO. 2005-0167-WR
On June 15,2005, the Commissioners ofthe Texas Commission on Environmental Quality
considered a petition to modify an Agreed Order to update the described reservoir capacity of Lake
Corpus Christi. This Agreed Order was originally issued by the Commission on April 28, 1995 to
establish operating procedures pertaining to Special Condition SoB. of Certificate of Adjudication
No. 21-3214, and was last modified on January 5,2004. Certificate of Adjudication No. 21-3214
.is owned by the City of Corpus Christi, the Nueces River Authority, and the City of Three Rivers.
The City of Corpus Christi, as managing entity, has requested authority to amend Section2oco
'.J f the Agreed Order to reflect the findings of the most recent bathymetric survey of Lake Corpus
C'hristi, increasing the calculated capacity of the Lake from 241,241 acre-feet to 257,260 acre-feet,
dt conservation pool 940' above mean sea level.
The Executive Director finds that this request to modify the Agreed Order to reflect the most
recent bathymetric survey ufLake Corpus Christi is reasonable.
Accordingly, Subparagraph 2.c. ufthe Agreed Order is modified to read as follows:
For purposes ofthis Agreed Order, Reservoir System storage capacity
shall be determined by the most recently completed bathymetric
survey of each reservoir. As of2004. completed bathymetric surveys
of each reservoir reports conservation storage capacities of 695,271
acre-feet (below 220.5 feet mean sea level) for Choke Canyon
ReservOlr (Volumetric Survey of Choke Canyon Reservoir, TWDB
September 23, 1993) and 257,260 acre-feet (below 94 feet mean sea
level) for Lake Corpus Christi (Volumetric Survey of Choke Canyon
ReservOlr, TWDB, November 15,2004).
