MODIFICATION TO AN AGREED ORDER
TCEQ DOCKET NO. 200S-0S66-WR
On June 15,2005, the Commissioners of the Texas Commission on Environmental Quality
considered a petition to modify an Agreed Order, relating to establishing operating procedures
pertaining to Special Condition 5.B., Certificate of Adjudication No. 21-3214 and continuing an
~dvisory Council, issued by the Commission on April 28, 1995, and last modified on January 5,
2004, relatmg to constmction deadlines as authorized by Certificate of Adjudication No. 21-3214.
Certificate of Adjudication No. 21-3214 is owned by the City of Corpus Christi, the Nueces River
~uthority, and the City of Three Rivers.
The City of Corpus Christl, as managing entity, has requested an extension of time to
complete the Nueces Estuary Rincon Bayou Diversion Proj ect due to delays encountered during the
pipeline project phase of the diversion project.
The Executive Director finds that this request for an extension of time is reasonable.
-\ccordingly. Subparagraph 2.f4. of the Agreed Order is modified to read as follows:
4. Constmction necessary to implement subparagraph 2.fl. shall
be accomplished by December 31,2001 and work necessary
to accomplish subparagraph 2.f2 shall be accomplished by
January 31. 2006
