KNOW ALL BY THESE PRESENTS:

THA T the undersigned, (GRANTOR) (whether one or more) whose interests are shown on the attached
Exhibit C, in consideration of Ten Dollars ($10) and other good and valuable consideration, paid by the
City of Corpus Christi (GRANTEE), 1201 Leopard Street, Nueces County, Texas 78469-9277, the receipt
of which is hereby acknowledged, has conveyed, and does convey to the City of Corpus Christi, a Texas
Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use,
liberty, privilege, and easement of going lU, on, over, under and along a certain tract ofland situated in
Nueces County. Texas and being described as follows

~ONSTRU(~TION_EASEMENT, is attached and incorporated as Exhibit B.
i'he /'emporary Construction Easement IS further described as a 30-foot wide construction easement,
,,;oUlh of and adjacent to the permanent Utllity easement. Said temporary construction easement is to be
used for workll1g room and storage of materials and machinery during the construction phase. This
iemporary Construction Easement automatically terminates upon completion and acceptance of the
improvements of the Buckingham Lift Station Force Main Routing project by the City Manager of the
(,t\ of Corpus Chnstl. T'exas.
SPECIAL PROVISIONS: (1) The City of Corpus Christi agrees to restore the land within the
easement areas to the same condition as existed prior to construction of the pipeline. (2) To the extent
allowed by Texas Law, Grantee agrees to fully indemnify, save and hold harmless the Grantor,
("Indemnitees") against all liability, damage, loss, claims, demands, and actions of any nature
whatsoever on account of personal injuries (including, without limitation on the foregoing workers'
compensation and death claims), or property loss or damage of any kind whatsoever, which arise out
of the use of the right-of-" ay or construction, installation, operation, use, maintenance, repair,
restoration, or removal of the improvements pursuant to this agreement.
Together with the free lIlgress, egress and regress to and for the City of Corpus Christi, Texas, and its
franch Iset's to construct, sep'ice, repair, maintain, inspect. lay, operate and keep public utility lines under,

TO H.'\ VE AND TO HOLD. ALL A!\D SINGULAR, the rights and privileges aforesaid to the City of
Corpus Christi, Texas, its successors, legal representatives, and franchisees for the use as a UTILITY
EASFMF\!T llld TEMPORARY CONSTRUCTION EASEMENT and right~of-way for so long as used for
such pw-pose, and if the LIse )f said easement and right of way is ever abandoned, then the aforesaid rights
and pnviJeges cease

FIELD NOTES to describe the boundary of a 10' wide utility easement across a tract of
land deeded to Agnes Polasek et a1. as described in Document #1998013018, Official
Records, Nueces County, Texas, said 10' wide utility easement being more particularly
described by metes and bounds as follows;
BEGINNING at a 5i8" steel rod set II1 the east right-of-way of South Staples Street (100'
R.O. \\T.) for the southwest corner of this easement from which the southwest comer of
said Polasek tract bears 5-280-43' - 19". W, 30.00',
THENCE, N-280-43'-19"-E, along said Staples Street right-of-way, a distance of10.00'
to a 5/8" steel rod set for the northwest corner of this easement;
THENCE, S-61 0-16' -41 "-E, a dIstance of 2146.47' to a 5/8" steel rod set in the west line
of a tract of land described in a deed to 4 Pegasus Enterprises as recorded in Document #
1999037558, Official Records, Nueces County, Texas and the east line of said Polasek
tract for the northeast comer of this easement;
THENCE, 8-280-33 , 55'-W, along said common line, a distance of 10.00' to a 5/8" steel
rod set for the southeast comer of this easement from which a 5/8" steel rod found in the
north right-of-way of Yorktown Boulevard (l00' R.O.W.) for the common corner of said
tracts bears S-280-33'-5S"-W, 30.00',
THENCE, N-610-16'41"-W, a distance of2146.46' to the POINT OF BEGINNING
and containing 0.493 acres ofland. more or less.
