" Utility Easement TH!~ S!ATFOFTEX~S ~ KNOW ALL BY THESE PRESENTS: Cat NTY OF NUECES ~ THA T the undersigned, (GRANTOR) (whether one or more) whose interests are shown on the attached Exhibit C, in consideration of Ten Dollars ($10) and other good and valuable consideration, paid by the City of Corpus Christi (GRANTEE), 1201 Leopard Street, Nueces County, Texas 78469-9277, the receipt of which is hereby acknowledged, has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation, its successors and legal representatives, the free and uninterrupted use, liberty, privilege, and easement of going lU, on, over, under and along a certain tract ofland situated in Nueces County. Texas and being described as follows See Lhe metes and bounds property descnption attached and mcorporated as Exhibit A. (Premises) .\ map showing the location of the UtilIty Easement, TOGETHER WITH A TEMPORARY ~ONSTRU(~TION_EASEMENT, is attached and incorporated as Exhibit B. i'he /'emporary Construction Easement IS further described as a 30-foot wide construction easement, ,,;oUlh of and adjacent to the permanent Utllity easement. Said temporary construction easement is to be used for workll1g room and storage of materials and machinery during the construction phase. This iemporary Construction Easement automatically terminates upon completion and acceptance of the improvements of the Buckingham Lift Station Force Main Routing project by the City Manager of the (,t\ of Corpus Chnstl. T'exas. SPECIAL PROVISIONS: (1) The City of Corpus Christi agrees to restore the land within the easement areas to the same condition as existed prior to construction of the pipeline. (2) To the extent allowed by Texas Law, Grantee agrees to fully indemnify, save and hold harmless the Grantor, ("Indemnitees") against all liability, damage, loss, claims, demands, and actions of any nature whatsoever on account of personal injuries (including, without limitation on the foregoing workers' compensation and death claims), or property loss or damage of any kind whatsoever, which arise out of the use of the right-of-" ay or construction, installation, operation, use, maintenance, repair, restoration, or removal of the improvements pursuant to this agreement. Together with the free lIlgress, egress and regress to and for the City of Corpus Christi, Texas, and its franch Iset's to construct, sep'ice, repair, maintain, inspect. lay, operate and keep public utility lines under, on and a long said PremIses TO H.'\ VE AND TO HOLD.
