AMENDMENT No.1
HEB TENNIS CENTER IMPROVEMENT PROJECT
CONTRACT FOR ARCHITECTURAL/ENGINEERING SERVICES
The City of Corpus Christl, Texas, hereinafter called "City" and Dykema Architects, Inc. hereinafter called
'Consultant", hereby agrees to the following amendment to the Contract for Architectural/Engineering Services
for the HEB Tennis Center as authorized by Motion No. 2005-298, passed August 30, 2005:
Section II, SCOPE OF SERVICES, Paragraph H. ADDITIONAL SERVICES, will be added to the contract to
read
H. ADDITIONAL SERVICES -
1. West Oso Park Tennis Court Rehabilitation: The Consultant will provide services as outlined by Section II.
Basic Services, Construction Phase Services, and Post Construction Services to result in the development of
plans, specifications, bid and construction documents to be issued as an addendum necessary to allow the
City to award a construction contract for the rehabilitation of four (4) tennis courts surface treatments, and
such fencing. parking and accessibility improvements as may be necessary and permitted by the authorized
budget
Section III. FEES Authorized IS amended to read:
III. FEES AUTHORIZED
The City will pay the Consultant an additional not to exceed fee of $4,000 for a restated total not to exceed fee
of $35,00000.
The total fee consists of the original contract fee and an additional service fee authorized by Amendment No.
1 The original contract fee consists of a not to exceed fee of $31,00000. This fee will be full and total
compensation for all services provided and expenses incurred in performing the tasks specified as basic,
construction, and post-construction phase services specified in Section II. The fee is inclusive of all expenses
incurred by the Consultant during the project
The table 'Summary of Fees" shall be used when calculating the fee due for the proportion of services
completed. The City shall make prompt payments in response to Consultant's statements for Professional
Services
Billing for services provided in Section II A, B, D, and E will be based on the Consultant's estimate of the
percent of services complete at the time of billing. The fee for additional services (Section II.E) is included as
part of the fee listed for Design, Bid and Construction phase services listed in the table "Summary of Fees".
However, in no case will the billing exceed 90% of the fee for each phase until the delivery of documents
associated with each phase has been reviewed and accepted by the City. Billing for services provided in
Section II.C 1 will be based on the amount of construction completed. Billing for services provided in Section
II. C.2 shall be payable upon delivery of the record drawings to the City Engineer. Billing for services provided
in Section II C will be payable upon performance of inspections and delivery of all materials to the City.
Consultant will submit monthly statements for work authorized by the City Engineer and performed by the
Consultant The statement will be based upon Consultant's estimate and concurrence by the City of the
proportion of the total services actually completed at the time of billing. The City will make prompt monthly
payments in response to Consultant's monthly invoices
All inVOices shall be accompanied by a cover letter summarizing the fee in accordance with the Summary
Schedule of Fees Invoices will be sequentially numbered for each project and state the project name. The
letter shall state the number of the current invoice, the contract fee for each task, the amount previously
