This agreement is between the City of Christi, Texas, a Texas home-rule municipal corporation ("City"),
P. () Box 9277. Corpus Christi, Texas 78469-9277 acting through its duly authorized City Manager or designee and
Corpus Christi Appraisal Service, Inc. ("Appraiser") of 5926 S. Staples, Suite C-I, Corpus Christi, Texas 78413, for
the preparation of a Real Estate Appraisal for one ( I ) parcel which is to be acquired by the City in connection with
Project #7351, Edinburg Circle Buyout.
NOW THEREFORE. the City and the Appraiser agrees as follows:
A. The Appraiser agrees to the following:
(1) Prepare an appraisal report ( 1 004 B) for one residential property with address of 5205 Edinburg
Circle. Corpus Christi, Texas 784] 3 and with Legal Description of Lot 6, Block 5, Inverness Unit A. The City will
acquire fee simple rights to this property and will need a market value based on the sales comparison approach. The
f!QP!aiser is notified that this property is structurally deficient . The appraiser is instructed to provide a hvpothetical
appraisal as if the residential structure is structurally sound and in good condition. The appraiser will transmit the
appraisal report to the City an electronic .pdf file format
The City reserves the right to amend the legal description(s) of the parcel(s) and to revise parcel(s), if
necessary, and to add parcels for an additional tee. Where applicable, parcels with both fee and easement takings will
be I reateu as one ( I ) parcel.
(2) The appraiser will abide by the latest edition of the Uniform Standards of Professional
Appraisal Practice (USP AP). in developing and reporting the appraisal. The report must show all applicable
approaches to value and state any departures taken. Show all comparable sales and provide a map locating the
comparable sales. Do not include sales data of property acquired under the threat of eminent domain.
(3) The Appraiser wi II complete this appraisal assignment and submit to the City within 10 days
after receipt of a Letter of Authorization to Proceed.
(4) The Appraiser agrees to share information on comparable sales in the area in a cooperative
manner with other appraisers appraising in the area for the City
(5) The Appraiser agrees to meet with the City Property and Land Acquisition Division Manager
to discuss the appraisal( s) prior to completion and shall submit all reports to Property and Land Acquisition Division,

(6) The Appraiser agrees that Appraiser will make a personal inspection of each parcel to be

(7) It is further agreed that appraisal information concerning the property assigned for appraisal
services, whether contained in or within the appraisal report to the City or not, is to be treated as confidential. Breach
of such confidence by the Appraiser, except on written authorization by the City Manager or upon proper order of the
Court. is a material breach of this contract.

fee to recertifY the appraisal, upon the City's request, will be charged at a rate of $50 per report.
(9) If there are separately held interests in any parcel of real property to be acquired (such as
easements, leaseholds, tenant-owned improvements, life estates, etc.) the appraisal must include an apportionment of
the total just compensation to each separately held interest to be acquired. Acquisition will not include mineral rights.

(10) The Appraiser will comply with all Federal, State and Local laws and ordinances applicable to

due to activities of Appraiser's self, Appraiser's agents, or employees.
(12) The Appraiser shall attach a resume to the appraisal setting forth the Appraiser's technical
qualifications, general appraisal experience, specific experience in appraising properties of the type involved in this
project, the courts in which Appraiser has testified as an expert witness and any other information relating to
professional qualifications
(13) In agreelOg to the term s of this contract, the Appraiser hereby certifies that Appraiser does not
ha ve any interest (inc luding that of real estate broker or agent), direct or indirect, present or prospective, in any parcel( s)
described in this agreement or any other interest, whether or not in connection with said parcel(s), which would conflict
in any manner or degree with the performance of the services and submission of impartial reports, and has not
employed and will not employ, in connection with the services to be fumished hereunder, any person having any such
interest, and until such parcel(s) is (are) acquired by the City or excluded from its project, the Appraiser and any
employees of the Appraiser, so long as they are employed by the Appraiser, will not acquire any such interest and will
no!. for their own account or f()r other than the City. negotiate for any of said parcel(s), perform services in connection
with said parcel(s), or testify voluntarily as a witness in a condemnation or other proceeding with respect to such
parcel(s)
B. fhe ~i!y agrees to provide the following to the Appraiser:
(I) Fumish copies of any available survey data for the parcel.
(2) Furnish copies of any available title information for the parcel.
(3) Provide information on comparables, if any, available to the City.
C. Payment:
In consideration of work to be performed by the Appraiser as discussed in Section A, subsections 1-13
herein, the City agrees to pay Appraiser the sum of $350.00 for the total assignment with payment to be made upon
completion ofthe total assignment and correction of any errors.
D. fermination:
The City Manager reserves the right to terminate this contract with cause at anytime. Termination may
include the entire contract or may include only selected parcels that the City desires to delete. In either case, the City
agrees to pay Appraiser only for the work completed at the time oftermination.

E. Assignability:
The Appraiser shallllot assign, transfer or delegate any of Appraiser's obligations or duties of this
<.:ontract to any other person without prior written consent of the City Manager except for routine duties delegated to
personnel of the Appraiser's staft
F. Appraiser Proposal Letter:
The IlfJpraiser's proposal letter, stamped as Exhibit C, is attaehed hereto and made a part ef this

G. Fee:
The "CITY" agrees to pay the appraiser for services provided in accordance with Exhibit C, under this
AUREEMENT a total fee not to exceed $350.00 (Three hundred fifty and no cents)
