RATIFICATION and AMENDMENT No.13 - AGREEMENT
FOR
ARCHITECT/ENGINEER CONSULTANT SERVICES
The City of Corpus Christi, Texas hereinafter called "City", and Shiner Moseley and Associates, Inc.,
hereinafter called "Engineer" agree to the following amendments to the Contract for Engineering Services
for the Cefe F. Valenzuela Landfill, as authorized by Motion No. 96-035, passed February 13, 1996, and
as amended by Motion No 96-318, passed October 15, 1996, and as administratively amended on March
14, 1997, March 27, 1997, November 4, 1997, Motion No. 97-380, passed December 23, 1997, and
Motion No 99-358, passed October 12,1999, and administratively amended September 22, 2000,
administratively amendment January 13, 2003, and Motion No. 2004-459 passed December 21, 2004
and Motion 2005-385 passed November 8, 2005, and Motion 2006-007 passed January 17, 2006.
SECTION III ADDITIONAL SERVICES
The Engineer is authorized to proceed with the following services
B ADDITIONAL SERVICES
TASK 416 Modification of MEP Plans and Specifications.
The Engineer will provide the City with design modifications prior to advertising for bids as follows:
maintenance barn - modify bid documents to include air conditioned office space and restrooms and
modification of welding receptacles and provide revised plumbing, mechanical, and electrical plan
sheets, schedules and specifications.,
· scales house - provide design support for the inclusion of a bar code reader system;
· crew building - delete men's and women's showers;
· standby generator - provide preliminary field investigation, calculation of equipment, conduit and
cable sizes and cost estimate for installation at the KEDT transmitter site;
· entrance gate - data communications building plan, elevations and PCR building specifications;
fiber optic routing plan - deletion of seven (7) fiber optic drawings and addition of four (4) new
electrical key plans;
wireless communication system - provide radio and networking equipment specifications and
wireless communication system architecture diagram; and
SBC back telephone service - coordination of service and routing with SBC including revision of
drawings and specifications for telephone service.
The Engineer will provide the City with addenda modifications prior to bid opening as follows:
wireless communications system - field survey and measure the KEDT transmitter site, City Service
Center and Frost Bank Building and provide the City Engineer with plans, details, and diagrams; and
pump house chlorination - provide the City Engineer with specifications for a pulse chlorinator,
chlorine detector. electrical plan modifications, and panel schedule for the chlorinator system.
SECTION VI FEE is amended by the insertion of Phase III fees to read:
'Section VI FEE.
The City will pay the Engineer a restated total not to exceed fee of $3,700,440.00. This fee will be full
and total compensation for all services provided and expenses incurred. The fee is subject to the
availability of funds. The Engineer may be directed to suspend work pending receipt and appropriation of
funds This amendment authorizes the following fees
A FEE FOR ADDITIONAL SERVICES
The City agrees to pay the Engineer for services provided in accordance with the Scope of Services and
Fee under this Amendment, a fee for additional services not to exceed $24,950.00. The revised total fee
as amended is not to exceed $3,725,390.00. The total amended fee is the full and total compensation for
all services provided and expenses incurred by the Engineer. For services provided in Section III
'Additional Services" the Engineer will submit monthly statements for basic services rendered.

Engineer's statement will be based upon Engineer's estimate of the proportion of the total services
actually completed at the time of billing. For services authorized by the Director of Engineering Services
under Section III "Additional Services", the City will pay the Engineer a fixed fee for providing services
authorized as shown by the Summary of Fees

DEFINITIONS
a
"Board Member". A member of any board, commission or committee appointed by the City Council of
the City of Corpus Christi, Texas
"Employee" Any person employed by the City of Corpus Christi, Texas either on a full or part time
basis, but not as an independent contractor.
"Firm" Any entity operated for economic gain, whether professional, industrial or commercial and
whether established to produce or deal with a product or service, including but not limited to, entities
operated in the form of sole proprietorship, as self-employed person, partnership, corporation, joint
stock company, joint venture, receivership or trust and entities which, for purposes of taxation, are
treated as non-profit organizations.
"Official". The Mayor, members of the City Council, City Manager, Deputy City Manager, Assistant City
Managers, Department and Division Heads and MUnicipal Court Judges of the City of Corpus Christl,
Texas
"Ownership Interest" Legal or equitable interest, whether actually or constructively held, in a firm,
including when such interest is held through an agent, trust, estate or holding entity "constructively
