Permit and Contract For Use of Public Beach by Clear Channel Broadcasting Inc.

Whereas, Clear Channel Broadcasting Inc. ("Promoter") of 501 Tupper Lane, Corpus Christi,
Texas, has applied for a Beach Festival Permit ("permit") with the City of Corpus Christi ("City")
to conduct an outdoor musIc festival on Newport Pass Padre Island ("Festival Site") on June 10-
1 1 , 2006:
Now therefore, In accorda nee with Section 10-115 of the City Code of Ordinances, Promoter
agrees to the following conditions and stipulations
1) Promoter shall pay to tne City of Corpus Christl ("City") the reasonable value of any lost,
damaged, or destroyed park or beach facilities in the vicinity of the festival.
2) Temporary or portable buildings, structures, or improvements at the Festival Site shall meet
all city building codes and be kept In a safe, sanitary and sightly condition.
3) Upon the expiration of the permit, all temporary or portable buildings, structures, and
improvements placed on the Festival Site by Promoter shall be removed and Promoter shall
restore Festival Site to Its former condition
(4) Promoter shall furnish the bond required under Section 10-115 (4) of the City Code of
Ordinances. Promoter shall promptly, by no later than 11'59 p.m. June 11,2006, remove all
garbage trash, debris and refuse from the Festival Site and shall promptly, by no later than
11 :59 p.m June 11, 2006, restore the Festival Site to its former condition. However, if Promoter
fails to comply with this subsection Promoter agrees to reimburse the City, within 30 days of
receipt of Invoice. for City's costs to restore the Festival Site to its former condition. The Clean
Up Plan (Exhibit A) and the Bird Sanctuary Protection Plan (Exhibit B) are attached.
5) Promoter shall provide liability insurance and all other relevant insurance as specified by the
City's Risk Manager or Risk Manager's designee prior to Issuance of the permit.
(6) Promoter shall not discriminate against any person or group on the basis of race, color,
religious preference, ethniclty, national origin, disability, or sex and that all facilities provided in
connection with the beach festival shall be reasonably available to all persons in attendance.
7) Promoter shall observe and comply with all applicable laws, ordinances, regulations, and
rules of the federal, state, county, and city governments
(8) Promoter shall provide a Traffic Control/Security Plan (Exhibit C) and Parking Plan (Exhibit
D) showing the location of sufficient on-beach and off-beach parking space to accommodate the
anticipated attendance
(9) Promoter shall affirm and demonstrate that the Festival Site is accessible from existing
beach access roads and that the festival will not block or unduly interfere with beach access
roads or normal beach traffic or Interfere with normal beach use by those not participating in the
festival.
!. 10) Promoter has a duty to protect the dunes and IS responsible for mitigating any damage to
the dunes caused by the beach festival

11) Promoter agrees to comply With all provisions of Article XI, Chapter 10, City Code of
Ordinances. including but not limited to executing Police Services Agreement (Exhibit E);
securing approval of the Fire Prevention Plan (Exhibit F) by the City's Fire Marshal; obtaining
required temporary certificate of occupancy by the City's Building Official; and reimbursing City
for all costs Incurred by City as required by ~ 10-115 (1) Code of Ordinances.

certificate for additional penods from the expiry date hereof However, neither: (a) the Surety's decision not to
issue 8 continuation certificate, nor (b) the failure or inability of the PrinCipal to file a replacement bond or other

The 29th Annual C-101 C-Sculptures
Clean Up Plan
In accordance with C-1 01's application for an Outdoor Music Festival Permit for
the 29th Annual C-101 C-Sculptures event being held June 10, 2006, adjacent to
Newport Pass Beach from 8am - 5pm, a plan of action for the purpose of trash
removal and to return the event site to its original state will be implemented. This
plan of action includes assistance from Clear Channel Broadcasting employees,
volunteers secured by Daiquiri Richard from the Beautify Corpus Christi
A.ssociation (B.C C.A) and assistance from citizens from the community. Below
is an outline of how this plan will be executed to ensure that our commitment will
be met.
Clear Channel Corpus Christi's four (4) FM broadcast signals, KNCN 101.3,
KRYS 99.1, KMXR 93.9 and KSAB 99.9 and two (2) AM broadcast signals,
KKTX 1360 and KUNO 1400, will combine their resources to promote the
removal of trash from the beach by visitors to the area. These resources include
uSing the Individual station broadcast signals to announce public service
announcements promoting beach clean up, station websites, with posted tips and
Information to educate the public about the environmental impact of litter, plus
the use of station volunteers who will collect trash from the event site on June 10,
2006.
C-1 01 will cond uct a contest to encou rage citizens and visitors to take a
proactive approach to cleaning up not only their trash but also the trash of their
neighbors as well Through a series of promotional announcements, C-101 will
promote a contest to reward individuals who collect trash the day of the event. It
will be conducted in the following manner: A trash collection center will be
located on site with printed signs clearly marking its location. Individuals will be
asked to pick up trash bags, courtesy of B.C.C.A, at this station. The bags are
free to the public and will be given to anyone who needs one, regardless if they
are participating in the contest. The contest is designed to encourage people to
bring their bags of trash to the trash collections station, where their name will be
logged as well as the number of full trash bags they are contributing. They will
be allowed to collect more bags and continue to contribute more bags of trash if
they wish, A collective tally of the number of trash bags contributed by each
Individual will then be logged and a 1 S\ 2nd and 3rd place reward will be awarded
to the people with the most bags. Prizes include dinner gift certificates, concert
tickets, vouchers to theme parks and other promotional items.

We will coordinate with Bill Davis of the S.P.u.R.S. program to conduct a beach
clean up on Sunday (06.11), Monday (06.12) and Tuesday (06.13). The clean up
will be done in the area from Zahn Road to Access Road 3 (see following page).

29th Annual C-101 C-Sculptures
Bird Sanctuary Protection Plan
June 10, 2006 Newport Pass, TX
C-101 is prepared to ensure the protection of the fragile bird sanctuary in two
ways: Posted security and an aggressive on-air public service announcement
campaign.
Assigned security guards will be posted at two different locations around the bird
sanctuary during the event. These positions will be setup in areas that are most
prone to public invasion Heavy traffic near the sanctuary is not expected with
the change in layout (stage and vendors facing south rather than east) and with
the sand berms (created while road graters are clearing the area for set-up)
acting as an additional barrier to bird sanctuary.
Also, C-101 will aggressively pursue an on-air campaign providing a minimum of
500 PSA's ($30,000 value) from May thru Labor Day informing the public of the
sanctuary's existence, and that it is a protected area where no one shall be
permitted to enter during the event. It will be left to the County Board of Parks
and Recreation discretion on what content they would like to air. PSA's that
follow after the event will stress environmental awareness, including bird nesting.
The Nueces County Parks Department and the U.S. Fish and Wildlife
Department will be credited on every PSA. In 2005, with the help of our sister
stations, we ran 1,489 PSA's for a value of $89,340.
As always, C-101 would appreciate and consider any additional ideas from the
county to further protect the fragile environment of the bird sanctuary.
C-101 is looking forward to a successful and safe event which will allow visitors
to enjoy a day of live music and art as they watch sculptors from around the
country take part In the 29th Annual C-1 01 C-Sculptures.

Traffic/Security Plan
June 10, 2006 Newport Pass, Texas
Safety is of great concern in this year's 29th Annual C-101 C-Sculptures as we
work to inform the public. with the help of The Corpus Christi Police Department,
of the importance of safety in order to have another successful event.
Closing Newport Pass Road to the public and making Zahn Road one-way
no later than 7am Saturday, June 10th. Newport Pass road will still be used by
staff and sponsors of the event through out the day on Saturday. Special passes
will be provided to distinguish staff and sponsors. Traffic will be routed to Access
Road 3. Visitors can drive towards the event and park along the beach. Traffic
will be one way with Zahn Road and Access Road 3A (south of Zahn Rd.) as the
designated exits.
C-101 staff and sponsor parking. Three (3) RVs will arrive at Newport Pass
Friday, June 9TH at noon and will be parked at the event site. These will be
designated for Law Enforcement (Command Center), for entertainment and for
event staff. These trailers will not be available for use until the morning of the
event. An empty trailer as well as the bands' and stage company's equipment
trucks will be parked directly behind the stage. A designated area will be
available for staff and sponsor parking.

In addition, we will coordinate with the Sector 2 Commander of the Corpus Christi
Police Department and institute a similar Law Enforcement Plan (from last year)
for this year's event. Updated documentation of this plan will be added to this
application when it is finalized

On Site Security Plan
June 10, 2006 Newport Pass, Texas
Event Security Specifics:
3pm to 6pm Friday June 9: Two (2) security guards {Texas State Guard or
Eddie Garza Security (if the State Guard deploys)} will be on site to keep the site
clear during set-up.
6 pm to 10pm Friday (06.09) I Saturday (06.10) Morning: Event site security
will be handled by two (2) Deputies and two (2) Texas State Guardsmen from
6p.m. to 10p.m. They will be in charge of keeping people out of the event site,
protecting structures (staging and vehicles) on the site and keeping people from
parking in designated areas. Two (2) Deputies and two (2) Guardsmen will carry
on the same duties from 10p.m. to 6a.m. Two (2) off-duty CCPD Officers will
patrol the sculpture area from 10p m. to 6a.m. to provide a safe environment for
sculptors to work.
Friday evening/Saturday morning Schedule:

used by emergency vehicles, staff, and sponsors of the event only throughout

sponsors. All other traffic should be routed to Access Road 3. (Day will be
divided into two shifts: tam - Noon and Noon - 5pm.).

9am to 4pm Saturday: (Registration TentIVlP Security): One (1) Guard and
one (1) Deputv will be stationed at the VI P tent entrance to check VI P badges
from 9am to 4pm. VIPs, Law Enforcement, EMS and Event Staff will be allowed
in the VIP tent
9am to 4pm Saturday: (Beer Garden-TBD): Two (2) Deputies will be stationed
at the beer garden tent to observe crowds who will remain in the tent during the
consumption of alcohol sold on the premises. Four (4) Guardsmen will monitor
the perimeter of the fenced area to ensure this boundary is not broken by
persons trying to enter the area without properly entering the entrance to be ID'd.
7am to 5pm Saturday (Parking): One (1) Guardsman and one (1) Deputv will
be In charge of keeping unauthorized vehicles from parking in restricted areas at
the site. Only vehicles with permission from The Nueces County Parks Board,
The City of Corpus Christi and C-1 01 will be permitted to park inside the event
site staff parking area. These include: Band Vehicles, Staging Equipment
Trucks, RVs, the C-101 Vehicle, an ambulance, and staff vehicles. All vehicles
will be required to have parking passes. (Day will be divided into two shifts: 7am
- Noon and Noon - 5pm.)
10am to 4 pm Saturday (Stage): Five (5) Guards (w/sidearm) will be needed in
the main crowd area in front of the stage. One (1) Deputy is needed in the
backstage areas around the equipment trucks and stairs to the stage. One (1)
Guard will also be needed backstage to keep people off the stage.
Saturday Schedule:
7 a.m - 5 p.m.
8 Deputies (if possible) - A smaller plan may
implemented by Constable Bobby Sherwood.

Parking Plan
In accordance with C-101 's application for an Outdoor Music Festival Permit for
the 29th Annual C-101 C-Sculptures event being held June 10, 2006, adjacent to
Newport Pass Beach from 8am - 5pm, a plan of action for the purpose of public
parking will be Implemented. This plan of action includes assistance from
Copano Bay Excavation and the Nueces County Parks and Recreation
Department Below is an outline of how this plan will be executed to ensure that
our commitment will be met
With the assistance from Copano Bay Excavation, KNCN-FM/C101 will secure
heavy equipment to open a mile area of parking for the public south of the
event site (see attached map) The sand will be taken down to water level and
pushed aside to the dune line to allow for parking. With the help of the C.C.P.D.,
we will secure the Police Explorers (or another volunteer group) to help man the
parking lot and direct traffic in and out of the area.

CONTRACTUAL AGREEMENT
BETWEEN
THE CITY OF CORPUS CHRISTI
AND
CAPSTAR RADIO OPERATING COMPANY, DBA, C-IOl RADIO
STATION
CONTRACT FOR POLICE SERVICES
1bis contract to provide specific additional police services on an overtime basis for the
outdoor concert, festival and contest known as C-Sculptures (hereinafter referred to as "C-
Sculptures") is made and entered into this, the _ day of May, 2006, by and between the
City of Corpus Christi, a Texas home rule municipal corporation, acting by and through its
authorized City Manager or designee, and Capstar Radio Operating Company, (hereinafter
referred to as Capstar), a corporation, acting by and through its duly authorized agent or
designee
WHEREAS Capstar desires to contract with the City for additional overtime police services to
provide law enforcement, traffic and crowd control services to provide for safety and
protection of the public before, during and immediately after the above-described C-
Sculptures event; and
WHEREAS the City, by and through its Police Department, desires to assist in this effort by
providing additional police services to the C-Sculptures event on an overtime basis;
NOW, THEREFORE, Capstar and the City agree as follows
Scope of Services
The City agrees to provide for the benefit of Capstar a reasonably sufficient number of sworn
police officers, as determined by the Chief of Police, including appropriate supervisors, on an
overtime basis to perform law enforcement, traffic and crowd control services in and around
the festival grounds and to enforce all local and state laws. Sworn officers shall at all times
remain part of, subject to and in direct relationship with the Police Department's chain of

command and shall remaIn subject to Police Department rules, regulations and operating
procedures
It is expressly understood that the Police Department shall be responsible for the
compensation of the officers and all employee benefits, as well as for any injuries to the
officers, their property, or the City' s property, while performing law enforcement duties for
the festival
The City agrees that if will proVide the officers, along with such equipment as may be
necessary and reasonable, in order to allow the police officers to carry out the duties
anticipated under this agreement
Reimbursement
Capstar agrees, in consideration for the additional police services, to reimburse the City for
the City's actual costs of compensating all assigned officers' overtime wages or equivalent,
based on each officer's overtime rate of pay. Reimbursement to the City will consist of a
monetary payment of 50 percent of said actual costs, and the remaining 50 percent will be
provided by Capstar to the City in the form of commercial radio broadcast airtime for the
City's use on radio statIOns which have a broadcast signal that includes the City of Corpus
Christi The City will use said airtime to provide information, advertisements or public service
announcements
The City agrees to provide Capstar with an lllvoice itemIZIng employee identification
numbers, hours worked performing assigned duties under this contract, and supervisory
approval and verification of the Payroll Time Sheets within 30 days of the conclusion of this
C-Sculptures event, to be held on June lOth and] I th 2006
Capstar agrees to make monetary payment in-full for 50 percent of the amount listed on the
invoice within 30 days after receipt of said invoice, and to provide the aforementioned
broadcast airtime to the City for its llse within one year of the date of execution of this
agreement
Termination
This agreement shall terminate within one year from execution or upon conclusion of the C-
Sculptures event, provision of the City's invoice, payment by Clear Channel, and provision by
Capstar and use by the City of the broadcast airtime, whichever occurs first
Construction of Laws
This contract is made and entered into in the City of Corpus Christi, Nueces County, Texas.
Any and all questions of law arising hereunder shall be construed in accordance with the laws
of Texas and venue shall be in the appropriate court in Nueces County where the contract was
executed and will be performed.
Entire contract
This contract of three pages constitutes the entire agreement between the parties. If any word,
phrase, paragraph, section or article of this contract is found to be invalid, unconstitutional or
illegal by final judgment of a court of competent jurisdiction, it does not affect any other
word, phrase, paragraph, section or article of this contract, because it is the intent of the
parties that every word, phrase, paragraph, section or article of this contract be given its full
force and effect
