AMENDMENT NO.4
TO CONTRACT FOR
PROFESSIONAL SERVICES
This City of Corpus Christl Texas hereinafter called "CITY", and Urban Enaineerina. hereinafter
called "CONSULTANT", agree to the following amendment to the Contract for Professional Services
for Downtown Drainaae Improvements. Phase 1, Proiect "An Water Street Interceptor and
Inlets (Proiect No. 2036) as authorized and administratively amended by:

· In the original contract Section 2. SCOPE OF WORK shall be modified by the addition of the
following scope as shown on the attached Exhibit "A'
1 Additional construction administration due to contractor's overrun of time.
2. Added 15 curb ramps to Water Street intersections and replacement of 88 feet of sidewalk.
3 Soil removal issues
4. Sanitary sewer repairs on Water Street.
· In the original contract. Section 3. FEE shall be modified as shown on the attached Exhibit "A"
for a total fee not to exceed $23.921.00 (in figures), Twentv- Three Thousand Nine Hundred
Twentv-One Dollars and Zero Cents (in words), for a total restated fee not to exceed
$1,179.820.00 (in figures), One Million One Hundred Seventy-Nine Thousand Eiqht Hundred
Twentv Dollars and Zero Cents (in words).
All other terms and conditions of the Contract and A~ts between the City and Consultant
will remain In full force and effect '\

Phase 1 Proiect A - Water St. Interceptor and Inlets

Dear Jerry
There are several issues concerning the downtown drainage projects that impacted the
completion or that we have been asked to address that is outside the scope of our engineering
services These issues are summanzed as follows:
AdditIonal construction administration due to Contractor's overrun of time.
:> Added 15 curb ramps to Water S1. intersections and replacement of 88 feet of sidewalk.

T'1e Contractor has greatly exceeded the completion time for the project. Original
Contract Time was 260 Calendar Days (8.5 Months). Construction time started January 21,
2005 and was supposed to be completed by September 7, 2005. The project was essentially
complete as of March 20 2006 for a total construction time of 424 Calendar Days (14 Months).
Time was exceeded by approximately 5 5 months Our engineering fee for the construction
administration of this project is $30,101. If the overrun is taken as a pro-rated value the
additional fee would be $19,477 (5.5 Mo x $30101/8.5 Mo) We have looked at actual cost for
the additional time due to the overrun and a cost breakdown is provided on the attached table.
The CuSi.:, are contributed to the tIme associated with additional preparation/review of pay
estimates and daily reports, the additional time required for site visits and status meetings with
City and Contractor We are requesting that an amount of $10,948 be provided to cover the
additional engineenng services. This amount should be covered by funds deducted from the
Contractor due to the time overrun
We were requested by Engineering Services Staff to add to the scope of the subject
project the construction of 15 new curb ramps along Water St. and Shoreline Blvd. The
additional engineering services required for each ramp included an initial investigation, obtaining
dimenSions of existing conditions preparing detailed sketch of new ramp, answering Contractor
and inspector's questions, checking progress and checking completion. The services also
Included contacting the Contractor concerning the additional work, negotiating and preparing
change orders and reviewing/approving the additional work in pay estimates. In addition the
Contractor was requested to remove and replace approx 88 of existing sidewalk, including two

driveways on the east side of Water St between John Sartain 51. and William S1. We assisted
with negotiating the Ghange order cost, prepared the change order, provided details to the
Contractor for the drrveways, coordinated the work. visited the site to check progress and
answer Contractor questions and reviewed/approved the additional work in pay estimates. A
breakdown of the additional time IS provided on the attached table. We are requesting that an
amount of $7 946 be provided to cover the additional engineering services.
An additional soil Issue has been encountered The soil issue required sampling and
testing to obtain approval from the Texas Commission on Environmental Quality to allow
disposal at the City's landfill. Ten samples were obtained from the soil stockpile and delivered to
the local office of Anal~sis Inc Testing results were rushed by Analysis Inc. to expedite
approval of the permit We are requesting that an amount of $3,512 be provided to cover
testing requirements
Contrae;tor was requested by Engineering Services Staff to add to the scope of the
project repairs to the existing sanitary sewer line in Water S1. between Coopers Alley S1. and
John Sartain St Construction Services staff has been managing most of this issue but we have
'ncurred some costs. The additional engineering services required for this item included minor
coordination before and during construction, preparation of traffic control exhibit, answering
Contractor and Inspector s questions, checking progress and reviewing/approving the additional
work in pay estimates A breakdown of the additional time is provided on the attached table. We
are requesting that an~mount of $1 515 be provided to cover the additional engineering
