HomeMy WebLinkAboutC2006-210 - 5/16/2006 - NA SECOND AMENDMENT TO THE CDBG SUBRECIPIENT AGREEMENT FOR FY 2002 BETWEEN THE CITY OF CORPUS CHRISTI AND WESTSIDE BUSINESS ASSOCIATION ThiS second amendment ('Second Amendment") is made by and between the City of Corpus Christi, Texas ("City") and the Westside Business Association ("Subrecipient"). a nonprofit corporation organized under the laws of the State of Texas Whereas, the City and Subreclpient executed an agreement ("Agreement") which was approved by the City Council on July 23 2002 (Motion 2002-228) for the purpose of utilizing the City's FY2002 ':ommunity Development Block Grant "'CDBG') program funds, Whereas, the parties to the Agreement executed the First Amendment to the Agreement to amend the scope and extend the term which was approved by the City Council on July 26, 2005 (Motion 2005-357); Whereas, the parties to the Agreement desire to execute this Second Amendment to reinstate and extend the term of the Agreement through October 31 2006 upon execution of this Amendment by the City Manager; Now. therefore the parties agree as follows Section 8. subsection 8.1 of the Agreement is deleted and replaced with the following language "8.1 Term The original term of this Agreement is 18 months A First Amendment, executed by both parties, extends this term an additional seven months, expiring March 31, 2006. A second Amendment, executed by both parties. extends this term an additional seven months, expinng October 31 2006 Notwithstanding any provision to the contrary, Subrecipient shall be bound by all covenants, terms, and conditions of this Agreement, including without limitation. recordkeeping, for a penod of six (6) years commencing on the date of the Subreclpient's execution of this Agreement. or of a First or Second Amendment, whichever is later L By execution of this Second Amendment, the parties agree to reinstate the original Agreement and extend the term an additional seven months, expiring October 31 2006.
