HomeMy WebLinkAboutC2006-211 - 5/16/2006 - NA SECOND AMENDMENT TO THE CDBG SUBRECIPIENT AGREEMENT FOR FY 2002 BETWEEN THE CITY OF CORPUS CHRISTI AND NEIGHBORHOOD CENTERS OF CORPUS CHRISTI, INC. This second amendment ("Second Amendment") is made by and between the City of Corpus Christi. Texas ("City") and the Neighborhood Centers of Corpus Christi, Inc ("Subrecipient") a nonprofit corporation organized under the laws of the State of Texas Whereas the City and Subrecipient executed an agreement ("Agreement") which was approved by the City Council on July 23, 2002 (Motion 2002-228) for the purpose of utilizing the City's FY2002 Community Development Block Grant ("CDBG") program funds; Whereas the parties to the Agreement executed the First Amendment to the Agreement to amend the scope and extend the term, which was approved by the City Council on March 30, 2004 (Motion 2004-129); Whereas the parties to the Agreement desire to execute this Second Amendment to reinstate and extend the term of the Agreement through October 31, 2006 upon execution of this Amendment by the City Manager, amend the scope, and to accordingly amend provisions of the Agreement: Now, therefore the parties agree as follows 1. Section 1, subsection 1 1 of the Agreement is deleted and replaced with the foUowing language '1.1 Scope of Work. Subrecipient, through its contractors and subcontractors will complete designs and plans to rehabilitate the Sub recipient's neighborhood center facility located at 2020 Marguerite Street ("Improvements") to continue its use by low and moderate income individuals and individuals with disabilities, For the purposes of this Agreement, the term "Facilities" collectively includes the above-mentioned real property and any improvements thereon." 2. Section 7, subsection 7 7 of the Agreement is deleted and replaced with the following language '7.7 Use of Funds. Subreciplent agrees that all funds expended under this Agreement shall be used solely for the activities described in this Agreement. Subrecipient shall reimburse the City for all funds expended for activities not related to said activities described above. 2006-211 OS/16/06 Nei~hbm'h()od Centt:l"s 3. Section 8 subsection 8 1 of the Agreement is deleted and replaced with the following language: '8 1 Term This Agreement terminates October 31, 2006. Extensions to the term of this Agreement may be requested by the Subrecipient and approved by the City Manager. However. the Sub recipient is bound by all covenants, terms, and conditions of this Agreement, Including without limitation, recordkeeplng, for a period of six (6) years commencing on the date of the Subrecipient's execution of this Agreement, unless a specific bound period is shorter or longer as may be stated in this Agreement" 4. Section 9, subsection 91 of the Agreement is deleted and replaced with the following language: "9.1 Improvements of Facilities. The City shall provide the Subrecipient up to Thirty-seven thousand twenty five dollars ($37,025.00) from the FY 2002 CDBG Program funds for Improvements to the Facilities as described in Section 1 herein and in accordance with the accepted bid. 5. By execution of this Second Amendment, the parties agree to reinstate the original Agreement and extend the term until October 31, 2006. All terms and conditions of the Agreement as amended by the First Amendment, not changed by this Second Amendment remain the same and in full force and effect.
