AGREEMENT
for
Geotechnical Investigation Services
This AGREEMENT is between the City of Corpus Christi, Texas, a Texas home-rule municipal
corporation, "CITY", acting through its duly authorized City Manager or designee ("City Engineer"), and Kleinfelder,

DECLARATIONS "CITY" desires to engage "LAB" to provide services in connection with
City'S project, described as follows: Cefe Valenzuela Landfill - Corpus Christi International Airport Microwave
Communieations Tower - Geotechnicallnvestiqaton (Proiect No. 5186) "PROJECT'.
2. SCOPE OF WORK "LAB" shall provide services to the PROJECT in accordance with the
accompanying Scope of Services and Fee Schedule attached as "Exhibit A" and the Terms and Conditions to
AGREEMENT attached as "Exhibit B"
3 FEE The "CITY" agrees to pay the "LAB" for services provided in accordance with Exhibit
"A" Scope of Services and Fee Schedule under this AGREEMENT, a total fee not to exceed $3.000.00 (in figures),
(Three Thousand and no/xx dollars (in words)
4, INDEMNIFICATION AND HOLD HARMLESS The Consultant agrees to indemnify, save
harmless and defend the City of Corpus Christi, and its agents, servants, and employees as more fully set forth in
Exhibit "B",
4. CITY'S DISCLOSURE OF HAZARDOUS & TOXIC MATERIALS AND CONDITIONS AT THE
PROJECT SITE, "CITY" warrants to "LAB" that to the best of its knowledge, based upon currently available
Information, the only hazardous or toxic materials, as defined by the laws and regulations of the Federal
government, the state, and city which exist at the PROJECT SITE are as follows: None "CITY" acknowledges
and confirms that "LAB" is relying upon the above warranty in undertaking to perform the services described in this

In behalf of Kleinfelder, 1 wish to thank you for asking our firm to provide you with this proposal to
serve as your geotechnical consultant for the V alenzuela Landfill/Airport communications tower at
the COIpUS Christi International Airport. This letter transmits our work scope pr~posal to conduct a
geotechnical investigation at the tower site. This proposal is based on the project information
provided to us by HDRJShiner Moseley & Associates, a site visit on May 9, 2006, and our
experience with the subsurface soil conditions in the vicinity of the site. Details of the proposed
work scope and estimated cost of the investigation are described in Attachments A and B.

Geotechnical Investigation
V alenzuela Landfill/Airport Tower
City Project No. 5038
Introduction: A new communications tower is planned for construction at the Corpus Christi
mternational Airport. The tower will be a three-legged, 120-foot tall, self-supported structure. The
foundation loads associated with the tower were not available at this time, but are expected to be
relatively light. The intent of this investigation as described herein is to provide the owner and their
design consultants with infonnation about the geology and subsurface soil conditions, and to
provide design recommendations for the tower foundation.
Field Investigation: We propose to drill one [1 J soil boring at the site to a depth of 40 feet below
existing grade. The borehole will be plugged with auger cuttings upon completion. We will make
short-term observations for ground water during the drilling operations. This investigation in no
way should be considered as a comprehensive ground water exploration.
The soil boring will be drilled with our truck-mounted drill rig. We plan to recover undisturbed
samples of cohesive clay soils. Standard Penetration tests (SPT) will be conducted in the event that
non-cohesive soils are encountered. All recovered samples will be properly labeled, wrapped and
sealed. All samples will be returned to the laboratory where they will be reviewed and
representative samples selected for testing.

Ebgineering Analysis, Recommendations and Report: Our project engineer will supervise the
field and laboratory investigations and prepare the geotechnical engineering report. All the results
of the field exploration and laboratory tests will be used in our analyses. We will provide the
results of our investigation in a formal written report. It will include a boring location plan, boring
logs and laboratory test results. The report will also describe our analyses and evaluations of the
tower foundation based on the particular soil conditions encountered at the site. We will provide a
total ofthree copies of the geotechnical report.

Schedule: We are prepared to begin the work within one to two working days after receiving a
notice to proceed assummg favorable weather conditions and the boring location is accessible to
our truck mounted equipment. Prior 10 commencing the field work, locations of underground
utilities, if any. below the project site should be determined. It should be noted that this process
takes a mmimum of two i 2], but usually three [3]. working days to complete.
Once underground utilities are located, we will begin the soil boring. The soil boring is expected to
require one [1] day to complete. Laboratory testing will begin as the field work is completed, and
we antiCIpate being able to complete all testing within 5 working days. Preparation of the reports
will require one week to complete once all testing has been finished. From start to finish, we
anticipate submittmg the reports to you within about two weeks after completing the field work.
Estimated Cost: The total estimated cost of our work is $3000. We will complete our assignment,
as we now understand the scope for this lump sum fee. We will not exceed this estimate total
unless the project work scope changes and unless written authorization is received. If services
beyond our above stated scope are requested, they will be performed at the unit rates contained in
Attachment B. The estimated fee includes location of the boring in the field and seeking clearance
of underground utilities, ~t'hich may be present at the soil boring location.
Sarveying and Access to Boring Locations: The fee estimate above assumes that the site is
accessible to our tnlck m,)unted drill rip Furthemlore, the fee estimate assumes that our drill rig
and support vehicles can negotiate the SHe under their own power without assistance.

Consultant agrees to indemnify, save harmless and defend the City of Corpus Christi, and its
agents, servants, and employees, and each of them against and hold it and them harmless
from any and all lawsuits, claims, demands, liabilities, losses and expenses, including court
costs and attorneys' fees, for or on account of any injury to any person, or any death at any
time resulting from such injury, or any damage to any property, which may arise or which
may be alleged to have arisen out of or in connection with the work covered by this contract.
The foregoing indemnity shall apply except if such injury, death or damage is caused by the
sole or concurrent negligence of the City of Corpus Christi, its agents, servants, or
employees or any other person indemnified hereunder.
