['hat the City of Corpus Christi {hereinafter the "City"), acting by and through its duly authorized City
Manager. CJeorge K Noe, for and in consideratIon ofthl' sum of Five Hundred Dollars ($500.00) to be paid in
hand by Star Cll EnvlroServlces, Inc., (hereinafter the "Permittee") of 1625 Highway 60 North, Bay City,
fexas, does grant, upon the C\lndiuons herem after stated, unto said Pem1ittee, a monitoring well permit for the
right to II1stalL operak, mainuin, and remove two mOllltoring wells, approximately 2-inches in diameter, 20-
feet in depth. with a 8-111Ch steel bolt well cover. with a 2-foot square flushed mounted traffic-rated well vault,
for appruxllnate I y a 2.:1- monti, period, one we 11 to be located on City property (Fire Station #8), and the other
well to be located at --+655 Kustoryz (Carcla S i\utO Service) within the southeast side of the Kostoryz Road
street right-or-way, nurth ofSunnybrook Street. 111 the City of Corpus Christi, Texas as shown on the attached
drawings marked Exhibit" A".
J() HA Vf A'\D TU HOLD the same unto Permittee, its successors and assigns, together with the
right and pnvilege under thl' conditions and tenns hereof, at any and all times to enter upon the above
described right-of-way for the purpose \)1 constructll1g, operating, maintaining, and removing of said
monitonng wells, and It is fu:ther understood that the foregoing monitoring well permit is granted upon the
tollowin~ condllions

B. PERMITTEE, ITS OFFICERS, MEMBERS, PARTNERS, EMPLOYEES, AGENTS,
AND LICENSEES (HEREINAFTER CALLED "PERMITTEE") SHALL FULLY INDEMNIFY,
SAVE AND HOLD HARMLESS THE CITY OF CORPUS CHRISTI, ITS OFFICERS, EMPLOYEES,
AGENTS, LICENSEES, AND INVITEES ("INDEMNITEES") AGAINST ANY AND ALL
LIABILITY, DAMAGE, LOSS, CLAIMS, DEMANDS AND ACTIONS OF ANY NATURE
WHATSOEVER ON ACCOUNT OF PERSONAL INJURIES (INCLUDING, WITHOUT
LIMITATION ON THE FOREGOING WORKERS' COMPENSATION AND DEATH CLAIMS), OR
PROPERTY LOSSORDAMAGE OF ANY KIND WHATSOEVER, WHICH ARISE OUT OF ORIS
IN ANY MAN~ER CONNECTED WITH, OR IS CLAIMED TO ARISE OUT OF OR BE IN ANY
WA Y CONNECTED \\lITH, THE PERFORMANCE OF THIS PERMIT, INCLUDING SAID
INJURY, LOSS OR DAMAGE CAUSED BY THE SOLE OR CONTRIBUTORY NEGLIGENCE OF
THE INDEMNITEES OR ANY OF THEM. PERMITTEE SHALL, AT ITS OWN EXPENSE,
INVESTIGATE ALL OF SAID CLAIMS AND DEI\IA~DS, ATTEND TO THEIR SETTLEMENT OR
OTHER DISPOSITION, DEFEND ALL ACTIONS BASED THEREON WITH COUNSEL
SATISFACTORY TO INDEMNITEES AND PAY ALL CHARGES OF ATTORNEYS AND ALL
OTHER COSTS AND EXPENSES OF ANY KIND ARISING FROM ANY OF SAID LIABILITY,
DAMAGE. LOSS. CLAIMS, DEMANDS A~D ACTIONS.

Monitonng Well Permit Agn:ement and the activities authorized by this Agreement, in the minimum amounts

additional msured. The insurance policies may not be canceled, renewed, or materially changed without 30
days advance written notice te the City's Director of Development Services, or the Director's designee. The
Permittee. or a representative or contractol (01 the Pernllttee, may not perfornl any work authorized by this
permit until the Permittee has presented nldence of the lI1surance coverage specified in Exhibit "B",
suffICient to satisfy the City's Risk Managel llpon reyuest of the City's Risk Manager, the Permittee shall
provide copies of all insurancl' policies to the Risk Manager
n E,xiJept as otherwise proVided herein, all work proposed will equal or exceed the Texas
Commission on Envlfonmental Quality (TeEQ) and thl..:' Texas Water Well Drillers Board rules, regulations,
and requirements for the insta Ilation, mOl1ltonng, and removal of monitoring wells.
At the time .)f removal, lhl..:' Pernlittee IS required to backfill the monitoring well. At a
mlIDmUl1L if the well falls inside eXlstll1g asphalt pawment, the top 10-feet will be filled with 3000 psi
l:oncrete and remaining depth with bentonite The City may elect, however, to fill the top 2-3 feet with soil, the
next 10-feet with 3000 pSI concrete and any remaining depth with bentonite. The alternate elective applies
primarily to those monitor wells which fall (Jutslde of eXisting asphalt pavement.
t. All applicable Federal, State.. County, and City laws and ordinances shall be complied with
and all necessary pem1i ts shal i be secured from the appropriate agencies prior to obtaining this permit. Copies
of said pennits shall be provided to the Ci1Y and attached hereto for all purposes as Exhibit "C".

Company), TimeWarner, and Grande ConmlUnications and any other companies that maybe affected by the
monitonng wells must be notified 72-hours prior to construction. 1-800-DIG-TESS, Lone Star Notification
Center (1-800-669-8344) and Southwestern Bell Telephone (1-800-828-5127) numbers must be notified 48
hours pnor to constnlction fn existing utility location..;
ComtructiOl plans and specifications for all work proposed will be submitted to the
Department of Engineering for approval prIor to beginning construction. The plans must show the depth and
location ufthe proposed comtruction and distance from the existing water, stornl, wastewater, and gas lines.
Pernlittee w:ll repair or cause to be repaired any damage to any landscaping, sidewalks, curb
and gutter. driveway, street, 'anital)' sewer, stornl sewer, drainage facility, underground lines, wires or pipes
owned by the City 01 C:orpm Christi (11 holders of an:: franchise from the City, resulting from or caused by
reason of construClJon operation, maintenance and/or removal of said monitoring wells.
K A Clty Inspector may request a utility line to be uncovered to verify its depth and/or location.
All backfil i and repairs of an Y' kind wi Il be made according to City standards and/or City Inspector's request.
All worK and repaIrs will be at Permittee's or its contractor's expense.
L If a City Inspector is reqUIred at the job site, the Permittee shall pay a daily rate of$301.31 for
each day spent inspecting 'constructIOn, mamtenance, repair, replacement, relocation or removal of the
monitonng wells pursuant t< the mot1ltonng well pennit Any time in excess of eight hours per day and any

R fhe construcllon of the momtoring wells and the use of said area hereby granted shall in no
way interfere with the constfLction or operatIon by the City or any of its franchisees of any existing or future
proposed sidewalks, utilIty lides, or other uses, or the maintenance thereof. If City (or any company with
existing utilIties iocakd in said right-ot.way) needs access to the right-of-way containing the monitoring wells,
Permittee shall be responsible for either repairing the monitoring wells to their original condition or removing
the momtonng \vells It whicl time thi~ MOll1toring Well Pem1it shall tenninate immediately.
fhe llghts 01 construcllon conferred herein shall not be assigned by Permittee without the prior
written consent of the City of Corpus Chnstl
fhe Monitonng Well Permit remains III effect during the Permittee's investigation and
assessment of possrble petrol!~um contamination. However, the Monitonng Well Permit expires f4 months
from the date of Issuance. Upon completion of the investigation and assessment the monitoring wells will be
removed in accordance witb the then current requirements of the City of Corpus Christi and the Texas
CommisslOn on l:nvironmenul Quality, or ltS successor agency in Austin. Texas, Provided, however, that ifat
the end ufsaid 24-month periud, the TCEQ requires additional monitoring ofthe well, then the City shall grant
to Permrttee an additional 24-month penoci in which to perform the work under this permit provided Permittee
pays an addltlonal $250.00 fur each monitonng well to City for the 24-month extension. The Permittee shall
notify the City's DepanmentJf Development Services. A TTN. Special Services Engineer, 48 hours prior to
removal of said monitoring vvells

We have lftCeived the Risk Based Assessment and proposal for additional assessment, quarterly groundwater
monitorlne, and producl recovery for the above referenced property. The report is considered complete and
approval" granted to Install five additional delineation wells. instead of the proposed four. Please note that the
confirmatltn soil boring will not be necessary at this time. PMW-4. 5, and 6 should be placed in the proposed
locations. PMW-7 should be moved further away from MW~3, meaning that the well will be installed across the
street. Costs for obtaining access to this property are included in the pre-approved amount In addition to the
proposedweHs. this office would like one well installed in the southeast corner of the property to further delineate
lhe prodUlt plume. A map showing the suggested well locations is attached. Please note that costs for sampling
the new _lis are included in the attached groundwater monitoring CARF.
