HomeMy WebLinkAboutC2006-378 - 8/24/2006 - NA DEVELOPER AGREEMENT FOR MAINTENANCE OF DRAINAGE IMPROVEMENTS STATE OF TEXAS ~ COUNTY OF NUECES ~ THIS AGREEMENT is entered into between the City of Corpus Christi, a Texas Home-Rule Municipal Corporation, P. O. Box 9277, Corpus Christi, Texas 78469-9277, hereinafter called "City" and Bryan Tucker, 3746 Scarlet Oak Dr., Corpus Christi, TX 78418, hereinafter calIed "Developer". WHEREAS, Developer in compliance with the City's Platting Ordinance, submitted the Lakes of the Northwest subdivision plat approved by Planning Commission on December 15, 2004, hereinafter called "Development", EXHIBIT A; WHEREAS, Developer has commenced construction of drainage infrastructure and related site improvements within the respective subdivision lot in accordance with construction plans and specifications approved by the City on January 26, 2006~ WHEREAS, Developer wants to proceed with construction of drainage infrastructure and site improvements to consist of a detention pond system discharging into the public right of way of PM 1889 as designed in the approved construction plans; WHEREAS, Developer is aware that the available outfalls for storm runoff from this subdivision are limited in capacity and the rate of discharge is subject to lexas Department of Transportation authority; and, ... WHEREAS, it is not appropriate for City to maintain the private detention pond located within an area to serve as a private park. NOW THEREFORE, for and in consideration of said City authorizing the construction of the private detention pond system as part of the permanent drainage infrastructure t6 serve the Development and adjacent unplatted property owned by Developer, City and Developer.. for and in consideration of the mutual covenants herein exchanged to be kept and performed, do hereby covenant; and agree as follows: REQUIRED IMPROVEMENTS The Developer will construct the first phase of a detention pond system, EXHIBIT B, to the 100 year storm frequency design and limit the discharge rate to that approved by the Texas Department of Transportation as documented in Storm Water System Report dated December, 2005, prepared by RYE, Inc., Developer's consulting engineer. 2006-378 daintenance of Drainage Improvements 08/24/06 Tucker. PLANSANDSPECnnCATIONS The Developer has prepared plans and specifications and construction contract for the installation of the required drainage improvements to serve the Development, through its consultants subject to review and approval by the City. DEVELOPER OWNERSHIP AND MAINTENANCE a. The Developer, its successors and assigns, shall assume maintenance of the concrete flumes between lots for (1) one year from date of acceptance. b. The Developer agrees, without exception, to allow and not restrict the flow of runoff from the adjoining properties in accordance with approved construction plans and agrees to be solely responsible for any and all damages that result from a lack of maintenance of the drainage improvements. CITY MAINTENANCE The City will repair and replace the drainage concrete structures with the exception noted below. The City will not be responsible for: 1. Maintenance of the detention pond in Lot 36, Block 9, including areawithin 20' drainage easement perimeter, at any time in the future, without exception. INDEMNIFICATION: OWNER, COVENANTS TO FULLY INDEMNIFY, SAVE AND llQJ:A{lARMLESS THE CITY OF CORPUS CHRISTI, ITS OFFICERS, EMPLOYEES; 1m> AGENTS, (ttINDEMNITEES") AGAINST ANY AND ALL LIABILITY, DAMAGE, LOSS, CLAIMS, DEMANDS AND ACTIONS OF ANY NATURE WHATSOEVER ON ACCOUNT OF PERSONAL INJURIES (INCLUDING, WITHOUT LIMITATION ON THE FOREGOING, WORKERS' COMPENSATION AND DEATH CLAIMS), OR PROPERTY LOSS OR DAMAGE OF ANY KIND WHATSOEVER, WHICH ARISE OUT OF OR ARE IN ANY MANNER CONNECTED WITH, OR ARE CLAIMED TO ARISE OUT OF OR BE IN ANY MANNER CONNECTED WITH THE CONSTRUCTION, INSTALLATION, EXISTENCE, OPERATION, USE, MAINTENANCE, REPAIR, RESTORATION, OR REMOVAL OF THE DRAINAGE IMPROVEMENTS ASSOCIATED WITH THE DEVELOPMENT OF LAKES OF THE NORTHWEST UNIT 1, INCLUDING THE INJURY, LOSS OR DAMAGE CAUSED BY THE SOLE OR CONTRIBUTORY NEGLIGENCE OF THE INDEMNITEES OR ANY OF THEM. This agreement is a covenant running with the land and shall become effective and shall be binding upon and shall insure to the benefit of the parties hereto and their respective heirs, successors, and assigns from and after the date of execution.
