benefits of the v,ork described belcm. hereby grants to the UNITED STATES OF
AMF':RICA. hereinaftLT caJled the ""(rovernmenf'. a right-of-entry upon the following
terms and conditions
lhe Owner hereby grants to the Government an assignable right to enter in, on,
\Jver and across the land descri bed on the attached map or drawing, for a period not
to exceed 18 m(lnths heginning with the date of the signing of this instrument. This
right-or-entry \\ ill permit the l inited States. its representatives, agents, contractors
and asslgns. to lise the descl'ilx:d land as a \\ork area for environmental
Investigation and response: lI1c1uding the right to temporarily store, move, and
remove equipment and supplies: erect and remove temporary structures on the
land. investigatl' and collect samples: c\)nstruct. operate. maintain, alter, repair and
remove CI former Naval Air Station hangar. the concrete foundation slab and the
securit: !'ence slIfrounding the hangar: cmd perform any other such work which
may be necessary and incident to the (Juvernment's use for the investigation and
response un sai(l lands: ~ubiecl to exist1t1g easements for public roads and
highway". public utilitie". raJiroads and pipelines: reserving, however, to the
landov,ner(s). their heirs. e:\ecutors. administrators. successors and assigns, all such
right. title. interest and privilege' as may he used and enjoyed without interfering
\vith or abridging the rights and right-or-entry herehy acquired.
Ihe O\\ner also grams the nght to enter and exit over and across any other lands of
the Owner as nccessarJ 1 (I 1I Sl~ the descri bed lands for the purpose listed above.
All tools. equipment. and other propert \ taken upon or placed upon the described
land by the GO\ernment shaJl remain the property of the Government and may be
removed by the Government ell anv time within a reasonable period after the
expiration of this right-of-entn

restore the ground contour. replace any pavement or other cover which was
remllved or damaged for thi" \\ork. establish a groundcover of grass on areas not

" In addition to the damage proVisions ot Paragraph 4, if any action of the
Government" s employee" 01 agents in the exercise of this right-of-entry results in
damage h) the real property. the Government will. in its sole discretion, either
repair such damage or make an appropriate settlement with the owner. In no event
"hall such repaiJ or settlement e'\ceed the fair market val ue of the fee title to the
real property at I he time immediately preceding such damage. The Government's
liability under this clause is subJect to the availability of appropriations for such
payment. and nl.thing conta!I1ed in this agreement may be considered as implying
