THA T. the Most Reverend Edmond Carmody, D. D., Bishop of Diocese of Corpus Christi, a
Corporate Sole, and His Successors in Office ("Grantor") of620 Lipan St., Corpus Christi, Nueces
County, Texas 78401, in consideration of$10.00 (TEN DOLLARS) and other good and valuable
consideration. paid by the City of Corpus Christi, ("Grantee") of 1201 Leopard Street, Corpus
Christl. Nueces County, fexas 78469-9277 the receipt of which is hereby acknowledged, has
conveyed. and does convey to the City of Corpus Christi, a Texas Home Rule municipal corporation,
11s successors and legal representatives. the free and uninterrupted use, liberty, privilege, and
easement of going in, on, (wer. under and along a certain tract of land situated in Nueces County,
Texas and being described as follows
See the metes and bounds property description attached and incorporated as
"Exhibit A', (Premises)
A map showing the locatIOn of the RIGHT-OF-WAY EASEMENT is
attached and incorporated as "Exhibit B" (Premises)
Together wIth the free ingress, egress and regress to and for the City of Corpus Christi, Texas, and its
franchisees. to construct. operate, repair and maintain streets, sidewalks, curbs, gutters and
appurtenances upon said Premises for the public use by foot, with automobiles, carts, carriages and
all other vehicles and all other means of transportation necessary or convenient at all times and in all
seasons in. along and upon said Premises. as well as to lay. operate, inspect, replace, repair, service
and maintam public utility lines. stom1 sewers. and franchised utility lines in, on, over, under and
along saId Premises.
SPECIAL PROVISIONS: The City of Corpus Chnsti agrees to construct a residential driveway
apron on Grantor's properly. Date of construction and location will be agreed to at a later time.
TO HA VE AND TO HOLD. all and singular, the rights and privileges aforesaid to the City of
Corpus Christi. Texas, Its successors, legal representatives, franchisees and the public, for the proper
use as public streets and utility easements for so long as used for such purposes, and if the use for
said easements and nghts \)fway is ever abandoned, then the aforesaid rights and privileges cease.

COUNTY OF NUECES
BEING A 0.003 ACRE (120.53 SQ. FT.), TRACT OF LAND OUT OF THAT
CERTAIN 5.9 ACRE TRACT OF LAND, DESCRIBED IN DEEDS, RECORDED
IN VOLUME 1947, PAGE 937 et seq, AND BEING OUT OF THAT SAME
TRACT OF LAND CONVEYED IN VOLUME 175S, PAGE 687 et seq, OF THE
DEED RECORDS OF NUECES COUNTY, TEXAS, THIS TRACT BEING MORE
PARTICULARL Y DESCRIBED BY METES AND BOUNDS AS FOLLOWS;
COMMENCING, at a 5/8 iron rod., found., at an angle point in the south boundary line of that certain
10.00 acre tract of land., described in deed, recorded in Document No. 2001042729, of the Official
Records of Nueces County, Texas, same line being the north boundary line of that certain right-of-way
(variable width), known as Up River Road and;
THENCE, South 390 49' 26" East (Record - North 390 50' 29" West), with above described common
boundary line of said 10.00 acre tract of land and Up River Road, a distance of 408.24 feet, to a 5/8 inch
iron rod, found at another angle point in said common boundary line of the 10.00 acre tract of land and
Up River Road;
THENCE, South 550 16' 41" East (Record - North 550 17' 44" West), continuing with said common
boundary line of the 10.00 acre tract of land and Up River Road, at 173.92 feet, pass the common
southerly corner of said 10.00 acre tract of land and aforementioned 5.9 acre tract of land, continuing with
said north boundary line of Up River Road., same line being the most westerly segment of the south
boundary line of said 5.9 acre tract of land., in all a distance of 278.24 feet, to a point, for the northwest
corner and PLACE OF BEGINNING of this tract;
THENCE, South 690 45' 25" East, a distance of 44.44 feet, to a point, on another segment of above
described common boundary line of the 5.9 acre tract of land and Up River Road, for the northeast comer
of this tract;
THENCE, North 82047' 15" West, with said common boundary line of the 5.9 acre tract of land and Up
River Road., a distance of 24.06 feet, to a point, for a comer of this tract;
THENCE, North 55016' 41" West, continuing with said common boundary line of the 5.9 acre tract of
land and Up River Road, a distance of 21.69 feet, to the PLACE OF BEGINNING and containing 0.003
acres (120.53 square feet) afland.
