and do convey to the Clty of Corpus Christi, a Texas Home Rule municipal corporation, its
successors and legal representatives, the free and Lmmterrupted use, liberty, privilege, and easement
of going 111. on, over. under and along a certain tract of land situated in Nueces County, Texas and
being descnbed as follow.,

Map (shaded) showing the location of the RIGHT-OF-WAY
EASEMENT is attached and incorporated as "Exhibit B".
Together WIth the free mgress. egress and regress to and for the City of Corpus Christi, Texas, and its
franchIsees. to construct. operate, repalr and mamtain streets, sidewalks, curbs, gutters and
appurtenances upon Sald PremIses for the public use by foot, with automobiles, carts, carriages and
all other vehicles and all other means oflransportatlOn necessary or convenient at all times and in all
seasons m. along and upon said Premises, as well as to lay, operate, inspect, replace, repair, service
and mamtam public uti lit\ lines. stoml sewers, and franchised utility lines in, on, over, under and
along saId Premise~.
fO HA VE AND TO HOLD, all and smgular, the nghts and pnvileges aforesaid to the City of
Corpus Christi. T ex as, its successors, legal representatIves, franchisees and the public, for the proper
use as publIc streets and utility easements for so long as used for such purposes, and if the use for
said easements and nghts of way is ever abandoned, then the aforesaid rights and privileges cease.

STATE OF TEXAS
COUNTY OF NVECES
BEING A 0.023 ACRE (983.13 SQ. FT.), TRACT OF LAND OUT OF LOT 1,
BLOCK 1, McKINZIE SUBDIVISION, A MAP OF WHICH IS RECORDED
IN VOLUME 41, PAGE 122, OF THE MAP RECORDS OF NUECES
COUNTY, TEXAS, THIS TRACT BEING MORE PARTICULALRLY
DESCRIBED BY METES AND BOUNDS AS FOLLOWS;
BIGINNING, at a point on the north boundary line of that certain right-of-way (60.00 feet wide),
known as Up River Road, same line being the south boundary line of said Lot 1, Block 1, McKinzie
Subdivision, for the southeast corner of this tract;
THENCE, North 63043' 28" West (Record - North 630 38' 38" West), with said north boundary
line of McKinzie Road and said south boundary line of Lot 1, a distance of 90.41 feet, to a point,
on the east boundary line of a Right-of-Way easement, Document # 822993, of the Official Public
Records ofNueces County, Texas, for the southwest comer of this tract, same point being the point
of curvature ofa circular curve to the right, which curve has a central angle of720 38' II", a radius
of 10.00 feet, a tangent of7.35 feet, and arc length of12.68 feet;
THENCE, with a curve to the right, and with the east line of said Right-of-Way easement, in a
northwesterly direction, an arc distance of 12.68 feet, to a point, for the southeast comer of this
tract:
TIlENCE. North 080 51' 39" Ea.qt. with said Right-of- Way Easement, a distance of 3.12 feet, to a
point, for the nonhwest corner of this tract:
TIlENCE. South 630 43' ~8" East. a distance of I 00.89 feet, to a point, for the northeast comer of
this tract.
THENCE, South 260 16' 32" West, a distance of 10.00 feet to the PLACE OF BEGINNING and
cOlhining 0.023 acres (983.13 square feet) ofland.
