HomeMy WebLinkAboutC2006-474 - 8/29/2006 - Approved,LoC(4- C,C 1.3 CITY OF CORPUS CHRISTI, DEL MAR COLLEGE DISTRICT, CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT AND NUECES COUNTY JOINT ELECTION AGREEMENT r This Agreement ("Agreement-) is made and entered into on the day of September, 2006. by and between Nueces County ("County'). and the City of Corpus Christi ( "City "), and Del Mar College District ! "DMCD''), and Corpus Christi Independent School District (CCISD) for the purposes and considerations stated below: WITNESSETH WHEREAS. the County will hold a general election within the boundaries of the County on the 7th day of November. 2006: and WHEREAS. the City will hold a special election within the boundaries of the City on the 7th day of November. 2006: and WHEREAS, the DMCD will hold a general election within the boundaries of the DMCD on the 7th day of November. 2006; and WHEREAS. the CCISD will hold a general election within the boundaries of the CCISD on the7th day of November. 2006. and WHEREAS, it is the finding of the governing bodies of the parties hereto that it would be mutually beneficial for the County. the City. DMCD and the CCISD to jointly enter into an Agreement to hold the elections jointly and also to enter into an Election Services Contract for the e provision of certain election services with by the County Election Officer of Nueces County, Texas: THEREFORE, pursuant to Chapter 271 of the Texas Election Code, the County, and the City. and DMCD and CCISD agree as follows: I. ELECTION RESPONSIBILITIES 1. In accordance with Chapter 271 (Joint Elections) of the Texas Election Code, the County agrees to oversee and coordinate the conduct of said election for City, DMCD, and (`CISD and oversee and coordinate the provision of services to prepare for and facilitate the joint election to be held on the 7th day of November. 2006. County, City, DMCD, and " ^ ,arty voting and regular election day voting shall be conducted jointly. 2006 -474 Nueces County, et al Page 1 of 4 In accordance with (. "hapter 11, Subchapter D of the Texas Election Code, City, DMCD and CCISD agree jointly to enter into an Election Services Contract with the County h lection Officer of Nueces County . Texas, for the provision of those certain election sere ices described in the Election Services Contract attached hereto as Exhibit A and incorporated herein by reference. the County shall bear its share of the cost for election sery ices. "[he County Election Officer, Diana I. Barrera, is hereby designated the Election Officer responsible for conduct and provision of the election services identified in the Election Sentoes Contract attached as Exhibit A. Said County Election Officer will ser e as the F arly \ oting Clerk_ and her designee will serve as the Counting Station Manager of the Central Counting Station for the joint election. Armando Chapa is )iereby designated the primary representative of City to oversee and coordinate with the County Election Officer in the conduct of the elections. J. L. Alaniz is hereby designated the primary representative of DMCD to oversee and coordinate with the County Election Officer in the conduct of the elections. Michael R Briones is hereby designated the primary representative of CCISD to oversee and coordinate with the (oLinty Election Officer in the conduct of the elections. In addition, Armando Chapa, as the City's Election \uthorit , .t_ I.. Alaniz , as the DMCD's Election Authority, and Michael R. Briones as the ( CISD "s Election Authority will perform or cause to be performed the following sere ices: Coordinate with County on the conduct of all aspects of City, DMCD and CCISD's elections. including (1) selection and establishment of early voting sites, and conduct of early noting locations of early voting substations are attached to this Agreement as Exhibit B), and i 2) designation of precincts, and polling places for use on election day (a list of polling places is included with this Agreement as Exhibit C). Coordinate the handling and disposition of City. DMCD and CCISD election returns, voter ballots. and tabulation of unofficial returns, and preparation of the tabulation for the official cam ass by governmental entities. Provide information sere ices for voters and election officers relating to City, DMCD and CCISD elections d. Maintain custody of City, DMCD and CCISD returns for a period as required by the Texas Election Code. II PAYMENT [he County. City, DMCD and CCISD agree to each pay Nueces County for their share of the expenses of the election on a prorated basis dependent upon the number of entities participating in the joilit election. Such payments will be made within 30 days of receipt from she County Election Officer of an itemized statement of the exact costs, expenses incurred and outstanding expenses related to the performance of election services, with City, DMCD, ''C1SD and County_ each payini2 their respective shares of such costs and expenses. II1. Page 2 of 4 MISCELLANEOUS County City, DMCD and CCISD will each be responsible for preparing and filing their own - espective submissions and any amendments, if any, to the Justice Department for pre - .:learance as may he required under Section 5 of the Voting Rights Act of 1965, as amended. Each party will be responsible for posting or publication requirements necessitated by federal, state or local laws as they may pertain to implementation of the respective issues placed on the ballot Each party will be responsible for receipt and processing filings of financial report statements by special purpose committees relating to the party's own respective elections. 3 Each party will be responsible for receipt and processing of applications of candidates for places on the ballot for its own positions, handling of drawings for places on the ballot for such positions, and the posting and issuance of any notices related thereto. 4 County will order separate ballots for City, DMCD and CCISD containing all propositions and regent candidates, respectively, to be voted on at the joint polling places, but a voter may not be permitted to vote on a City ballot containing a proposition, or a DMCD ballot containing candidates and a proposition, or a CCISD ballot containing candidates and a proposition on which the voter is ineligible to vote. Iv. GENERAL PROVISIONS l This Agreement shall be construed in accordance with applicable Federal Election Laws, the Texas Election ('ode, and all applicable laws of the State of Texas. County, City, DMCD, and CCISD through their respective Election Authorities, may agree to amend or modify this Agreement in the event federal, state, or local law requires additional or different actions by the Election Authority, which is beyond the scope of this contract. Such amendment or modification shall not be effective unless such amendment or modification is it, writing and signed by the parties to this Agreement. This Agreement constitutes the entire Agreement of the parties, supersedes any prior undertakings or written or oral agreements between the parties and can be modified or amended only by written instrument subscribed by each of the parties. The Contracting 7fficer shall be responsible for performing the following duties and shall furnish the following services and equipment THIS AGREEMENT is entered into in consideration of the mutual covenants and promises hereinafter set out; DUTIES AND SERVICES OF CONTRACTING OFFICER. The Contracting Officer shall be responsible for performing the following duties and shall furnish the following service and >auipment (a) Contact the owners and custodians of county- designated polling places and arrange for their use in the Joint Election ((,) Contact the owners or custodians of some other public (or if unavailable, private) building in the precinct and arrange for its use as a polling place if the county designated polling place in the precinct is unavailable for use in the Joint Election. ) Provide Judges Booth Controller (JBC), eSlate equipment and booths for Early Voting and Election Day polling locations, transport machines and equipment to and from the polling places (d) Early Voting and Election Day standby for mechanical breakdowns of voting equipment. (e) Procure and distribute all necessary election supplies, election kits, and voting booths and if applicable, program, generate and distribute mail in ballots. (f) Conduct all aspects of early voting, including, but not limited to, both permanent and temporary branch early voting by personal appearance. (g) Arrange for the use of Central Counting Station, Tally Early Voting results and arrange Early Voting Ballot Board meeting for the tabulating personnel and equipment needed at the Counting Station during Early Voting, and assist in the preparation of programs and the test materials for the tabulation of the ballots to be used with electronic voting equipment. n) Notify the election judges of the date, time and place of the election school, to arrange for a facility for holding the school, and conduct all training sessions for the election judges. Publish the legal notice of the date, time and place of the test of the electronic tabulating equipment and conduct such test. Supervise all procedures of the election and make such decisions as necessary to conduct the Joint Election in conformity with the law. Provide estimated cost of Election by Attachment "A" Paragraph 2. GENERAL CONDITIONS Nothing contained in this contract shall authorize a change in the officer with whom or the place at which any document or record relating to the election is to be filed or the place at which any function is to be carried out, or the officers to make the official canvass of the election returns. the officer to serve as custodian of the voted ballots or other election records or any other nontransferable functions specified by Section 31.096 of the Texas Electior. Code The contracting officer is the agent of City of Corpus Chirsti for the purposes of contracting with the third parties with respect to the election expenses reasonably incurred within the scope of the Contracting officer's duties. 3 The Contracting Officer shall file copies of this contract with the County Treasurer and the County Auditor of Nueces County, Texas. An estimate of the cost for the Election by services is Attachment' A ". 4 , Only the actuai expenses directly attributable to the Contract may be charged. (Section 31.100(b), Texas Election Code). The County Election Officer must submit the actual costs for items contracted for pursuant to this Contract to the City of Corpus Christi, no later than 60 days after the final Joint Election. '006: and WHEREAS. it is the finding of the governing bodies of the parties hereto that it would be mutually beneficial for the County. the City. DMCD and the LISD to jointly enter into an agreement to hold the elections jointly and also to enter into an Election Services Contract for <t provision of certain election services by the County Election Officer of Nueces County, eras: THEREFORE, pursuant to Chapter 271 of the Texas Election Code, the County, and the t'itv.. and DMCI) and 1 ISD agree as follows: I. ELECTION RESPONSIBILITIES In accordance with Chapter 271 (Joint Elections) of the Texas Election Code, the County agrees to oversee and coordinate the conduct of said election for City, DMCD, and LISD and oversee and coordinate the provision of services to prepare for and facilitate the joint Page 1 of 4 election to he held on the 7th day of November. 2006, County. City, DMCD, and LISD agree that early, voting and regular election day voting shall be conducted jointly. In accordance with 'hapter 1. Subchapter D of the Texas Election Code, City, DMCD and LISD agree jointly to enter into an Election Services Contract with the County Election Officer of '4ueces County. Texas, for the provision of those certain election ser ices described i °i the Election Services Contract attached hereto as Exhibit A and incorporated herein by reference. [he County shall bear its share of the cost for election set-, ices. The County Election Officer. Diana F. Barrera, is hereby designated the 1 lection Officer responsible for conduct and provision of the election services identified in the Election Sere ices Contract attached as Exhibit A. Said County Election Officer will serve as the Early ti oting Clerk, and her designee will serve as the Counting Station Manager of the Central Counting Station for the joint election. Armando Chapa is hereby designated the primary representative of City to oversee and coordinate with the County Election Officer in the conduct of the elections. J. L. Alaniz is hereby designated the primary representative of DMCD to oversee and coordinate with the County I1ectior Officer in the conduct of the elections. Scott Frazier is hereby designated the primary representative of LISD to oversee and coordinate with the County Election Officer in ?.he conduct of the elections. In addition, Armando Chapa, as the t ity 's Election Authority ..1 L. Alaniz, as the DMCD's Election Authority, and Scott Frazier as the T.ISD s Election authority will perform or cause to be performed the following services: Coordinate with County on the conduct of all aspects of City, DMCD and LISD's elections. including (1) selection and establishment of early voting sites, and conduct of early voting i locations of early voting substation are attached to this Agreement as Exhibit B), and (2) designation of precincts, and polling places for use on election day (a list of polling places is included with this Agreement as Exhibit C). Coordinate the handling and disposition of City. DMCD and LISD election returns, voter ballots. and tabulation of unofficial returns. and preparation of the tabulation for the official cany ass by governmental entities. c. Provide information services for voters and election officers relating to City, DMCD and I,ISD elections. d. Maintain custody of Cit . DMCD and LISD returns for a period as required by the Texas Election t'ode. II PAYMENT l'he County. City, DMCD and I ISI) agree to each pay Nueces County for their share of the expenses of the election on a prorated basis dependent upon the number of entities participating in the joint election. Such payments will be made within 30 days of receipt from the County Election Officer of an itemized statement of the exact costs, expenses incurred and Page 2of4 outstanding expenses related to the performance of election services, with City, DMCD, LISD and County each paying their respective shares of such costs and expenses. MISCELLANEOUS ( ot nty. City_ DM( D. and 1 ISD will each be responsible for preparing and filing their own respective submissions and any amendments, if any, to the Justice Department for pre - clearance as may be required under Section 5 of the Voting Rights Act of 1965, as amended. Any amendments to the joint submission shall be prepared and submitted by each respective part _: l ach party will be responsible for posting or publication requirements necessitated by federal. state or local laws as they may pertain to implementation of the respective issues placed on the ba11oi I ach party will be responsible for receipt and processing of applications of candidates for places on the ballot for its own positions. handling of drawings for places on the ballot for such positions. and the posting and issuance of any notices related thereto. Each party will be responsible for receipt and processing filings of financial report statements by special purpose committees relating to the party's own respective elections. County will order separate ballots for City. DMCD and LISD containing all propositions and regent candidates, respectively, to be voted on at the joint polling places, but a voter may not be permitted to vote on a City ballot containing a proposition, or a DMCD ballot containing candidates and a proposition, or a 1.ISD ballot containing candidates and a proposition on which the voter is ineligible to vote. Iv. GENERAL PROVISIONS This Agreement shall be construed in accordance with applicable Federal Election Laws, the Texas Election Code. and all applicable laws of the State of Texas. County. City. DM('D. and I -.ISD through their respective Election Authorities, may agree to amend or modif this Agreement in the event federal, state, or local law requires additional or different actions by the Election Authority, which is beyond the scope of this contract. Such amendment or modification shall not be effective unless such amendment or modification is in writing and signed by the parties to this Agreement. This Agreement constitutes the entire Agreement of the parties, supersedes any prior undertakings or written or oral agreements between the parties and can be modified or amended only by written instrument subscribed by each of the parties. DMCD and the TMISD to jointly enter into an .Agreement to hold the elections jointly and also to enter into an Election Services Contract for LI provision of certain election services with the County Election Officer ofNueces County, exas: THEREFORE, pursuant to Chapter 271 of the Texas Election Code, the County, and the 'ity- and DMCD and TMISD agree as follows: I. ELECTION RESPONSIBILITIES In accordance with Chapter 271 (Joint Elections) of the Texas Election Code, the County agrees to oversee and coordinate the conduct of said election for City, DMCD, and TMISD and oversee and coordinate the provision of services to prepare for and facilitate Page 1 of 4 the joint election to he held on 7th day of November. 2006. County, City, DMCD, and 1"MISD agree that early voting and regular election day voting shall be conducted jointly. In accordance with Chapter 31. Armando Chapa is Thereby designated the primary representative of City to oversee and coordinate with the County Election Officer in the conduct of the elections. J. L. Alaniz is hereby designated the primary representative of DMCD to oversee and coordinate with the County Election Officer in the conduct of the elections. Dr. Cornelio Gonzalez is hereby designated the primary representative of TMISD to oversee and coordinate with the County Election Officer in the conduct of the elections. In addition, Armando Chapa, as he City's Election Authority ..1. L. Alaniz. as the DMCD's Election Authority, and Dr. t`ornelio Gonzalez as the TMISD's Election Authority will perform or cause to be performed the following services: Coordinate with County on the conduct of all aspects of City, DMCD and TMISD's elections, including (1) selection and establishment of early voting sites, and conduct of early voting t locations of early voting substation are attached to this Agreement as Exhibit B), and (2) designation of precincts, and polling places for use on election day (a list of polling places s included with this Agreement as Exhibit C). Coordinate the handling and disposition of City. DMCD and TMISD election returns, voter ballots. and tabulation of unofficial returns, and preparation of the tabulation for the official can ass by governmental entities. Provide information services for voters and election officers relating to City, DMCD and TMISD elections, d. Maintain custody of City, DMCD and TMISD returns for a period as required by the Texas Election Code. 11 PAYMENT hhe City, DMCD and TMISD agree to pay Nueces County for their share of the expenses of the election on a prorated basis dependent upon the number of entities participating in the Joint election. Such payments will be made within 30 days of receipt from the County Election Officer of an itemized statement of the exact costs, expenses incurred and Page 2 of 4 outstanding expenses related to the performance of election services, with City, DMCD, M1SI) and County each paying their respective shares of such costs and expenses. MISCELLANEOUS County will not be responsible for preparing and filing a joint submission on behalf of City. DMCD. and iMISD to the Justice Department for pre - clearance as may be required under Section 5 of the Voting Rights Act of 1965, as amended. Any amendments to the joint submission shall he prepared and submitted by each respective party. Each party will be responsible for posting or publication requirements necessitated by federal, state or local laws as they may pertain to implementation of the respective issues placed on the hallo,. 1 ach party will be responsible for receipt and processing filings of financial report statements by special purpose committees relating to the party's own respective elections. County will order separate t'ity ballots for City, DMCD and TMISD containing all propositions and regent candidates. respectively, to be voted on at the joint polling places, but a voter may not be permitted to vote on a City ballot containing a proposition, or a DMCD ballot containing candidates and a proposition, or a TMISD ballot containing candidates and a proposition on which the voter is ineligible to vote. 1v. GENERAL PROVISIONS [his Agreement shall be construed in accordance with applicable Federal Election Laws, the Texas Election Code, and all applicable laws of the State of Texas. County. Cats. (c) Provide Judges Booth Controller (JBC), eSlate equipment and booths for Early Voting and Election Day polling locations, transport machines and equipment to and from the polling places. (d) Early Voting and Election Day standby for mechanical breakdowns of voting equipment. (e) Procure and distribute all necessary election supplies, election kits, and voting booths and if applicable, program, generate and distribute mail in ballots. (f) Conduct all aspects of early voting, including, but not limited to, both permanent and temporary branch early voting by personal appearance. (g) Arrange for the use of Central Counting Station, Tally Early Voting results and arrange Early Voting Ballot Board meeting for the tabulating personnel and equipment needed at the Counting Station during Early Voting, and assist in the preparation of programs and the test materials for the tabulation of the ballots to be used with electronic voting equipment. (n) Notify the election judges of the date, time and place of the election school, to arrange for a facility for holding the school, and conduct all training sessions for the election judges. (I) Publish the legal notice of the date, time and place of the test of the electronic tabulating equipment and conduct such test.
