HomeMy WebLinkAboutC2006-499 - 11/14/2006 - Approved CONTRACT FOR ARCHITECTURAL/ENGINEERING SERVICES The City of Corpus Christi, Texas hereinafter called "City", and Gignac Associates, L.L.P. hereinafter called "Consultant" hereby agree as follows I. SERVICES TO BE PERFORMED The Consultant hereby agrees, at his/her own expense, to perform all architectural/engineering services necessary to research, document, and complete the project described as follows. II SCOPE OF SERVICES The Consultant's services will include basic research, documentation and other services to complete the project as set forth. The Consultant, in the performance of this contract, will exercise usual and customary professional care in Consultant's efforts to comply with the applicable codes and regulations of City, State, and other Federal authorities having jurisdiction including applicable fire codes, life safety codes, health regulations, Texas Department of Insurance Windstorm Protection 'equirements, the Americans with Disabilities Act, the Texas Department of Licensing and Regulation, Elimination of Architectural Barriers Program (Article 9102), the Texas Trench Safety Act, and the Storm Water Retention Act The Consultant will include in the technical specifications a section entitled Trench Safety which Will incorporate by reference the legislation relating to the Texas Trench Safety Act The Consultant will coordinate design activities and design elements as directed by the City. The Consultant will work cooperatively with the Downtown Management District and Regional Transportation Authority, City's project manager, citizens, local organizations, City staff, elected ::>fflcials and others. Services will Include presentations to Council, which will be combined with other lleetings or presentations when possible The project Will consist of an assessment of Corpus Christi's downtown streetscape and way-finding opportunities The Consultant will identity goals, followed by the formulation of a way-finding diagram that summarizes audience groups, access routes, key decision points and lists a proposed hierarchy of sign types The scope of signage to be studied will include elements required for visitor vehicular navigation and pedestrian navigation from parking to various venues. The project scope of work will focus on the city of Corpus Christi, which is generally organized into the su b-districts of "DT own", "S EAT own", and potentially, "Shoreline Boulevard." We envision the DT own Wayfinding Assessment will build upon the findings from the previously prepared SEATown Wayfinding Assessment to create the base point for an overall City way-finding system which will establish continuity of way-finding and identity for visitors. These overall elements may be combined with unique district identity graphics to create a sense of place, It is understood that a DTown logo has been developed and approved and will be considered in the study. The study will build upon the findings from the earlier SEATown district way-finding study The streetscape portion of the project will consist of an assessment of DTown's streetscape condition, followed by the formulation of an urban design diagram that highlights streetscape hierarchy in the DTown District. Associated with the streetscape hierarchy diagram will be a proto-typical section for each major street, as well as a "typical" street section for non-major streets within DTown. Following development of streetscape ilierarchy diagram and street sections, streetscape treatments will be developed for . Site Furnishings (benches, trash receptacles. bike racks, etc.) . Lighting . Pavements . A. 1 0 1 1 STREETSCAPE Site Reconnaissance Consultant and its subconsultant(s), will prepare for and attend a kick-off meeting with the City and stakeholders to get a better understanding of needs within the DTown District, expectations of various streets, and to identify any concerns related to building development in the downtown. 12 Consultant and subconsultant will conduct a site reconnaissance to evaluate the current conditions in the DTown District. Distinguishing features and overall character of DTown will inform the guidelines. In particular characteristic elements to be evaluated include: · Building and parking placement in relation to the street. · Right-of-way width related to roadway needs, on-street parking needs, sidewalk and planting needs, and streetscape character. · Streetscape elements currently used throughout DTown. '3 The Consultant's design team will review the current zoning ordinance as it relates to the above elements to determine the existing rules shaping development and character of the street (i.e., bUilding setbacks, front yard requirements, density bonuses, or lot lines.) Work Products The Consultant will prepare and deliver to the City Engineer a summary memo of findings Site Trip The Consultant will make a one-day trip to conduct a site survey and stakeholder work session. 2. 0 Streetscape Alternatives The Consultant will use information learned during Task 1 to prepare the following exhibits for review with the City DMD and stakeholders · DTown Streetscape Hierarchy Diagram · Prototypical Street Section for major streets and a Prototypical Street Section for the prototypical streets · Proposed streetscape elements, including: 1 Site Furnishings 'benches, trash receptacles, bike racks, etc.) 2 Lighting 3 Pavements 4 Plantings · Develop recommendations for a prototypical bus shelter for the DTown District. We plan to select a fabricated shelter, rather than a custom design. · Develop a prototypical kiosk for the DTown District. Work Products The Consultant will prepare and deliver an alternatives report in PowerPoint format suitable for binding as a summary report. Site Trip The Consultant will make a one-day trip to conduct a site survey and stakeholder work session. 3 0 Streetscape Alternatives 3.1 Following comments received from the presentation and review with the City, DMD, and stakeholders, the Consultant will prepare a revised summary report for delivery to the City. Work Products: 1 Consultant will deliver to the City. Review current site photography. 1.2 The Consultant will prepare working signage base plans (city study area and district boundaries) 1.3 Consultant will be the primary contact and will guide review process and stakeholder work sessions. Stakeholders may include representation from the following: . downtown development organizations, · convention I visitors bureau and hotels (SMG) . City management, . City DPW I sign shop. . major venues and recreation areas, . arts and culturai entities, . public parking operators, . business owners. 1.4 Consultant will perform on-site driVing and walking tour to complete a photo-survey of area context, eXisting signage and signage opportunities. Work session with stake holder group to obtain feedback Jr . Vision, character, context, unique qualities, identity and way-finding goals . area history, key visitor destinations, public transit. . audience . entry pOints, parking goals, . circulation and traffic floVv, . city sign program management. 1.5 Consultant will prepare assessment report. Include survey photos accompanied by observations and work session comments and prepare a preliminary plan that delineates: City study area, with sub-districts key destinations including visitor parking, circulation paths coded by audience, . decision points and information needs 1.6 Consultant will submit a report to primary contact for distribution and comment. Work Products Consultant will deliver the City Engineer an Assessment Report in a Power Point format with annotations. 2.0 Preliminary Program The Consultant Will 21 Evaluate stakeholder comments 2.2 Refine sign plan. Prepare hierarchical list of recommended signage types. Locate sign types diagrammatically on plan 2.3 Initial selection of context-appropriate examples of district signage to illustrate potential solutions and design character H . Using selected site photos, block out 'zones" for potential sign locations. illustrating general proportions and locations. (i.e., vertical on median, vs low hOrizontal) Provide sketch-level alternatives of three (3) representative sign types for consideration 2.5 Review plans, hierarchy. precedent images and alternatives Supplement as required. Assemble show for stakeholder presentation 2.6 Conduct a second site trip 2 and work session with stakeholder group to obtain feedback. 2.7 incorporate stakeholder comments. submit final program report VVork Products The Consultant will prepare and deliver the City Engineer: 1 a way-finding plan. sign type list, precedent examples and preferred sketch concepts; and 2. a PowerPoint show with annotations. C. POINT OF CONTACT - The City Engineer will designate a single pOint of contact for all communications, information and documents to pass through. Any actions taken by the Consultant on instructions, information or concurrence provided by or through any other source will not be compensated under this ~ontract o COST CONTROL - The Consultant will participate in an estimate review and reconciliation for each design phase The City Engineer will use a cost consultant retained directly by the City for an independent review The Consultant will recommend changes in project scope or in the structure of bid alternates necessary to maintain project within budget as a result of each cost estimate and reconciliation. E ORDER OF SERVICES.. Consultant agrees to begin work immediately after written authorization from the City Engineer and to complete the site plan and programming services and other pre-design phase services including delivery of recommendations and report. The Consultant is also authorized to proceed with Design Phase and bid services The anticipated duration of tasks is attached as the Schedule of Services (Exhibit 'A") The anticipated schedule of services IS shown in Exhibit A. The City Engineer will provide a prompt response to the Consultant for guidance, direction. or approval of all work submitted in the various phases III. FEES AUTHORIZED The City Will pay the Consultant a total not to exceed fee of $48,00000. This fee will be full and total compensation for all services provided and expenses incurred in performing the tasks in Section II. The fee is inclusive of all fees and expenses incurred by the Consultant in the performance of this contract. The table Summary of Fees" shall be used when calculating the fee due for the proportion of services completed The City shall make prompt payments in response to Consultant's statements for Professional Services Consultant will submit monthly statements for work authorized by the City Engineer and performed by the Consultant The statement will be based upon Consultant's estimate and concurrence by the City of the proportion of the total services actually completed at the time of billing. The City will make prompt monthly payments in response to Consultant's monthly invoices All Invoices shall be accompanied by a cover letter summarizing the fee in accordance with the Summary Schedule of Fees. Invoices will be sequentially numbered for each project and state the project name. The letter shall state the number of the current invoice, the contract fee for each task, the amount previously inVOiced for each task. and the current amount due. Invoices will be organized to accommodate funding sources. During the construction phase, the ArchitecUEngineer will also submit a brief letter/memo summarizing observations during the site visit, the work of the contractor, construction progress for the billing period, and any pending items H '.HOME\KEV!NS\GEN\DMD\SlreerScapeWayfinding2006\AEcontract doc Page 4 of 6 Summa L___ Description Fee 24,000.00 24,000.00 TOTAL $48,000.00 I.A I.B Streetscape Way-Finding IV TERMINATION OF CONTRACT The City Manager may, at any time, with or without cause, terminate this contract upon seven days written notice to the Consultant at the address specified below If termination occurs prior to the final completion of all work contemplated by this contract, the Consultant shall be paid a reasonable compensation for the services actually rendered in accordance with the above-described schedule of fees and In proportion to the amount of work done on such stages or phases as have been authorized The foregoing shall not be construed to require the City Manager to compensate the Consultant for any services not performed in a proper professional manner. LOCAL PARTICIPATION The City Council's stated policy is that City expenditures on contracts for professional services be of maximum benefit to the local economy The Consultant agrees that local architectural and engineering liaisons will be used to the extent practical VII. OWNERSHIP OF DOCUMENTS All documents including contract documents (plans and specifications), record drawings, contractor's field data. and submittal data shall upon payment of all fees and reimbursable expenses owed under this agreement be the sole property of the City Those documents may be used by the City Engineer for other City projects, and with the exception of standard details that are not specific to this project may not be used again by the Consultant without the express written consent of the City Engineer. The City will assume sole liability for arising out of any reuse or modification of the Consultant's documents, except where the Consultant is found to be liable by a court or forum of competent Jurisdiction VIII. CORRECTING MATTERS Any extra cost and expense necessary to correct matters caused by failure of the Consultant or his/her sub- consultants to exercise a reasonable degree of professional care will be paid by the Consultant and not reimbursed by the City IX ASSIGNABILITY The Consultant shall not assign, transfer or delegate any of its obligations or duties under this contract to any other person without the prior written consent of the City. except for routine duties delegated to personnel of H rl 0 ME\KE VI NS\GEN\D M D\Street ScapeW ayfi nd i ng 2006\AE contract. d DC Page 5 of 6 the Consultant's staff No part of the Consultant's fee may be assigned in advance of receipt by the Consultant without written consent of the City The City shall not pay the fees of expert or technical assistance and consultants unless such employment, including the rate of compensation has been approved in writing by the City. X DISCLOSURE OF INTEREST In compliance with City of Corpus Christi Ordinance No. 17112, Consultant agrees to complete the City of Corpus Christi Disclosure of Interests form which is incorporated in the contract as Exhibit "C".
