NpW, THEREFORE, if the principal shall faithfully perform said work
in accordance with the p,~_ans, specifications and contract documents,
including any changes, ext.ensions, or guaranties, and if the principal
shali repair and/or replace all defects due to faulty materials and/or
woricmanship that appear w~thin a period of one (1) year from the date of
completion and acceptance of improvements by the City, then this
obligat}an shall be void; otherwise to remain in full force and effect.
FROVIDED FURTHER, that if any legal action be filed on this bond,
venue shall lie in Nueces County, Texas.
And that said surety for value received hereby stipulates that no
change, extension of time, alteration or addition to the terms of the
contract, or vo the ~.tiork performed thereunder, or the plans,
specifications, drawings, et~., accompanying the same shall in anywise
affect ~ts obligation on t_.his bond, and it does hereby waive notice of
any such change, extensior of time, alteration or addition to the terms
