TO THE
CDBG SUBRECIPIENT AGREEMENT
BETWEEN THE
CITY OF CORPUS CHRISTI
AND
AVANCE, INC.
This fir~ amertdment ("First Amendment") is made by and between Avance, Inc. ("Sub-
recipie~t"), and the City of Corpus Christi ("City").
WHER~AS, the City and the Subrecipient executed an agreement ("Agreement"), which was
approved by the City Council on September 13, 2005 (M2005-313), for the purpose of utilizing
the City's FY05 Community Development Block Grant ("CDBG") Program funds;
WHEREAS, the scope of work to be completed by the Subrecipient under the Agreement in-
cluded the construction of a new facitity to be located at 2822 Nogales Street;
WHEREAS, the Subrecipient has determined that the proposed location will not be adequate for
its needs;
WHER~IS, the Subrecipient has acquired property at 702 12~h Street, Corpus Christi, Texas,
on which is erected a building that the Subrecipient desires to rehabilitate; and
WHER~4S, the parties to the Agreement desire to execute this First Amendment to amend the
scope and location of the project stated in the Agreement.
Section 1. Section I, subsection 1.1, of the Agreement is deleted and replaced with the
following fanguage:
"1.1 Scope of Work. Subrecipient, through its contractors and subcontractors,
~hall r~habilitate an existing Facility by May 31, 2007, to be utilized by low and
modera~e income individuals and families, on real property owned by the Subre-
cipient at 702 12th Street, in the city of Corpus Christi ("Improvements"). For the
purposes of this Agreement, the term "Facility" or "Facilities" collectively includes
the above-mentioned real property and any improvements located thereon as of
the date of the Subrecipient's execution of this Agreement and includes, where
appropriate and in corttext, the proposed Improvements to be constructed with the
funding provided under this Agreement. All Improvements must be constructed in
accorclance with the plans and specifications ("Plans") prepared by the Subre-
cipienYs registered architect or licensed professional engineer retained pursuant to
subsection 7.3. No construction nor rehabilitation may commence until the Plans
are approved by the Administrator or the Administrator's designee ("Administrator"}
of the City's Community Development Division ("CDD") and by the City's Develop-
ment Services Department ("Development Services")."

Section 2. A copy of the most current Exhibit A is attached to this First Amendment and
replaces the prior Exhibit A for all intents and purposes. The attached Exhibit A is an estimate

of the proposed work to be completed and does not constitute the final budget and construction
schedule that are required under the Agreement.
Section 3. By execution of this First Amendment, the parties agree to amend the scope and
site location stated in the Agreement. All terms and conditions of the Agreement not changed
by this First Amendment remain the same and in full force and effect.
