(ine along side Airpost Uitch. 2.) A change in ownership of the railroad after the permit was submitted created addirional requirements that

1.) Proper planning at-d review of existing conditions and planned projects prior to design. 2.) This was beyond the control of the City, the
consultant, or the con~ractor because the change in ownership occurred after the design phase and after the permit was already submitted
