Home My WebLink AboutC2006-553 - 10/31/2006 - ApprovedFIRST AMENDMENT TO THE CDBG SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND METRO MINISTRIES This first amendment ("First Amendment") is made by and between the City of Corpus Christi ("City") and Corpus Christi Metro Ministries, Inc. ("SubrecipienY'). WH~2EAS, the City and the Subrecipient executed an agreement ("Agreement") on June 28, 2006, which was approved for funding by the City Council on December 20, 2005 (M2005-434), for the purpose of utilizing the City's FY05 Community Development Block Grant ("CDBG") Program funds; WH~tEAS, the City Council, on October 31, 2006, authorized a change in the scope of work to be complet~d by the Subrecipient. a change to the selected site location, and an extension of the term; and WHE#tEAS, the City and the Subrecipient desire to amend the scope of work and the site locatron of tMe property to be improved and to modify the term of the Agreement by execution of this First Amendment. Sect~n 1. Section 1, subsection 1.1, of the Agreement is deleted and replaced with the following language: ~`1.1 Scope of Wortc. Subrecipient, through its contractors and subcontractors, shakl design and construct a new facility, to be utilized by low and moderate income individuals and families, on real property owned by the Subrecipient and located at 1919 Leapard Street, in the city of Corpus Christi ("Improvements"). For the purposes of this Agreement, the term "Facifity" or "Facilities" collectively includes the above-mentioned real property and any improvements located thereon as of the date of the SubrecipienYs execution of this Agreement and includes, where appropriate and in context, the pro- posed Improvements to be constructed with the funding provided under this Agreement. All Improvements to the Facility must be completed by October 31, 2007. All Improve- ments must be constructed in accordance with the plans and specifications ("Plans") prepared by the SubrecipienYs registered architect or licensed professional engineer retained pursuant to subsection 7.3. No construction may commence until the Plans are approved by the Administrator or the Administrator's designee ("Administrator") of the City's Community Development Division ("CDD") and by the City's Development Services Department ("Development Services")." Sect~on 2. Section 7, subsection 7.9, of the Agreement is amended by deleting the date "May 31. 2007" and inserting the date "October 31, 2007." Section 3. Section 9, subsection 9.1, of the Agreement is amended by deleting the date "June 30, 2007" and inserting the date "November 30, 2007." Secti~n 4. Section 9, subsection 9.2, of the Agreement is amended by deleting the date "May 31 2~07" and insertinq the date "October 31, 2007." 2006-553 10/31 /06 M2006-348 Vlet~ro Ministries Sec~n 5. Section 9 is amended by including a new subsection 9.18 to read as follows: "The Subrecipient shall adhere and comply with the reporting requirements mandated for the Pertormance Management System, which is administered by the City, as a condition of receiving funds under this Agreement." Section 6. A copy of the most current Exhibit A is attached to this First Amendment and re- plac~s the prior Exhibit A that was attached to the Agreement. The attached Exhibit A is an estimate of the proposed work to be completed and does not constitute the final Project Budget and Construction Schedule that is required under the Agreement. Sectbn 7. By execution of this First Amendment, the parties agree to amend the scope of work and the site location of the property to be improved and to modify the term of the Agreement. All t~ms and conditions of the Agreement not revised by this First Amendment remain the same and in full force and effect.
