AGREEMENT

This agreement amends the second paragraph, Section 2a, Section 5, and Section 6a of
the Arterial Transmission and Grid Main Construction and Reimbursement Agreement
("Agr~merrt"), dated December 20, 2005 between the City of Corpus Christi ("City"), a Texas
home-rule municipality, P.O. Box 9277, Corpus Christi, Texas 78469-9277 and C.C.T.
Navic,~ption-Cameron, LP ("Developer"). of 45 NE Loop 410, Suite 290, San Antonio, TX 78216,
the A~reement is incorporated herein by reference, the same as if recited herein verbatim, the
terms and conditions shall r~main in force and effect, except as amended.
A The second paragraph of the Agreement is revised to read:
WHEREAS, Developer in compliance with the City Platting Ordinance, plans to develop
a tract of land, of approximately 8.615 acres called Navigation Pointe, Block 1, Lot 1
loca#ed east of Navigation Blvd. and south of Bates Drive, as shown on the attached
Exhibit 1.
B Se~tion 2 of the Agreement is revised to read
2. PLANS AND SPECIFICATIONS
a. The Developer shall contract with a professional engineer, acceptable to the
City's Direct~ of Engineering Services, to prepare plans and specifications for
the 12-inch PVC arterial transmission and grid main, as shown in Exhibit 2, with
the following basic design
(1) Install 664 linear feet of 12-inch PVC transmission/grid main.
(2) Install 4(four) 12-inch Gate Valve and Box.
C Section 5 of the Agreement is revised to read:
5. D~VELOPER AWARD CONTRACT FOR IMPROVEMENTS.
a. Developer sha~t award contract and complete the 12-inch arterial transmission
and grid main, in accordance with the approved plans and specifications, by
December 31, 2007.

C Section 6a of the Agreement is revised to read:
6. REIMBURSEMENT
a. The City will reimburse the Developer 100% of the cost of the 12-inch PVC
arterial transmission and grid main, not to exceed $46,864.63 within 30 days
upon invoicing by the Developer, if the work has been completed, inspected and
accepted by the City. The City agrees to conduct periodic inspections of the
progress of the work at key points during the construction.
