i . PARTIES AND NI.IRPOSE
~his 1~+~emurandum oi~L~nd~rst~ndi~~~ (M(>U) estahlishes an agreement between the Cities of
~~ictoria and Corpus Christi, located in ~I f:xas and Q.S. Department of Commerce, National
Oceanic and Atmospheric .~dministration. Oceanic and Atmospheric Research, Earth Science
Resear~h Laborator~~. Phvsical Sciences Divisio-1 (PSDj, through w~hich the Cities of Victoria and
~.`orpu~ C'hristi will pay PS[~ to opet-ate and maint«in the integrated boundary layer observing
~ystem which includes a 91 i-M~Iz 1)oppler Wind Profiler for contiiluous profiling of wind
~peed, w~ind directio~~. and ~leri~ed ~~lissin~ heights. a radio acoustic sounding system (IZASS) for
temperatui~~ profiling_ a gl~~ba] posisionin~~ svstem (GPS) receiver tor integrated water vapor
rnea>urements, and a 10-m tow~e~- tar characterizin;~ surface metearulogy (pressure, temperature_
?-elative hurniditv, ~~~ind, pr~~cipitati~~i~. sular and net cadiation). NOnA is undertaking to providc

knowledge by conductiiig developmental work for the improvement of survey~ng
and cartographic methods, instruments, and equipments; and to conduct
investigations and research in geoph~~sical sciences (including geodesy,
oceanograph~~, seismol~~g~, and geomagnetism).

expend funds made available by, any State or subdi~~ision thereof, any Federal agency,
~~r anv public or pri~~ate urganization, or individual, for surveys or investigations
at~thorized herein, or for performing related surveying and mapping activities,
including special-purpo~c maps, and for the preparation and publication of the
results thereof, ~ind to establish the terrns of an~~ agreement entered into under this
section, including the amouni of funds to be received, and may contribute that
portion of the cc~sts incu2•red ln~ the National Oceanic and atmospheric
Administration, includin~; ship time and personnel expenses, which NOAA
determines represents tl:~~~~ am~~unt of b<~nefits derived bti° the Administration from the
agreement

4). DUI~~TION OF AGRF:I;MEN~1. AME~NDMEN"rS AND MODIFICATIONS
['his a~reement will become effecti~e when signed by all parCies. The agreement will terminate
ti~n March _~ l, 2007. but may be ame~Idec't at any tirne by mutual consent of the parties.
~n~~ p~rty may termu~ate this agreement hy~ providing 30 days written notice to the other party.
This agreement is subject t~~ the a~~ailabilit~~ of fun~s.
! C~. IZ_ESULUTION OF DISAGRE~~~ ME~1~ ~I~S
Should disagreement arise ~~n the interpretation of the provisions of~this agreement, or
amenc~nents and/or r~visions thereta, that cannot he resolved at the operating level, the area(s) of
disagr~ement shall be statea in writ~zig by each party and presented to the other party for
~:onsid+eration. If agreement on interpretation is no~ reached within thirty days, the parties shall
iorti~ard the written precenl~tion of ~lle disagreement to respective 1ligher officials for appropriate
~~esol utif~n.
