~n hand b~ ATC Grc~up Sen-ices, Inc.. i hereinafter the "Permittee") of 140 Heimer Road, Suite 675, San
~~ntonio, Texas, does grant. upon the conditions hereinafter stated, unto said Permittee, a monitoring well
permit for t~e right to mstall, o~erate, ma~ntain. and remo~~e t~-o monitoring wells, approximately 2-inches in
~iiameter, 30-feet in depth. witl~; a~-lnch ~:ealed metal manhole cover, with a 2-foot square flushed mounted
t;affic-rate~i well vault. f~or approximate;~~ a~4 month period, to be located on the west side of the South
Staple~ Street right-of-v~•ay south of Kt~>ar Street. in the C itv c~f Corpus Christi, Texas as shown on the
tittached dra~l~ings marked Exhibit "A"

B. PERMITTEE, TTS OFFICERS, MEMBERS, PARTNERS, EMPLOYEES, AGENTS,

SAVE AND HOLD HARMI.ESS THE CITS" OF CORPUS CHRISTI, ITS OFFICERS, EMPLOYEES,

C. Permiut.e must tiave and ~Yia~ntain commerciai general liability insurance pertaining to the
?~tonitoring t~ ell Permit Agreement and the acti~~ities authf~rized by this Agreement, in the ininiinum amounts
se? forth in the attached and iz~:;orporate;~,' E~;llit~it B, The insurance policies must name the City as an
ac'tditiona~ insured. The insurant~e policie~, ma~ not be canceled. renewed, or materially changed without 30
cavs advance- written noric~e to tile Cin~'s I>irector of Deveiopment Services, or the Director's designee. The
F'erniittee, <}~- <~ representative o~ contractn~ of the Permitt~e, may not perform any work authorized by this
permit unti! tne Permittee has ~resented ~vidence of th~ insurance coverage specified in Exhibit "B",
sutficient t~~ satisfy the ~:~~-'s Rsk Mana~~~r. l!pun request of~the CitS~'s Risk Manager, the Permittee shall
pr.~vide eopie~ of all insarance ;~olicies tc `he R~sk Manager.
D. Except a~ othet~~ise pro . ided herein, al work proposed will equal or exceed the Texas
C~~mmissior~. cTn Environmental t,~ualit~~ (~ CEQI and the T exas Water W ell Drillers Board rules, regulations,
and requirements far the installation_ mor~tonng, and remo~~al of monitoring wells.
E. At the ~ime of :emo~'al. :he Permittee i~. required to backfill the monitoring well. At a
minimum, .~ the well falls inside e~istin~r asp6alt paven~ient, the top 10-feet will be filled with 3000 psi
c.oncrete and remaining depth ~~~tl~ bentol~~te. ~he City mav elect, however. to fill the top 2-3 feet with soil,
th~ nex? 10-teet with 300C? psi c~?ncrete an~ an~~ remaining depth with bentonite. The alternate elective applies
pnmariiy tc~ those monitar well~ which falf outside of existing asphalt pavement.
F. Ali appi~cable ~-ederal, Sr~te. C'ounty, and Cit~ laws and ordinances shall be complied with
and a11 ~iece~sary permits shall b~ secured from the appropl-iate agencies prior to obtaining this pernlit. Copies
c~i said permit~ shall he vm~~ideci to Che C~y anc~ attached hereto far all purposes as Exhibit "C".
G Ncj pubii~ stree?, or an} p<}rtion thereof, siiall be closed or barricaded to use by the public for
the purpose ~~f installmg. repairing, or ~z~aintaining the monitoring wells until after the Permittee or its
c~~ntractor has filed wtth this off ice an appr:~ved traffic control plan from the City Traffic Engineering Office.
H. All Crtv utilit. departments. ~~P (American Electnc Power), SBC (Southwestern Bell
('ompany). TimeW arner. and Grande Colnmunications and anti~ other companies that may be affected by the
m<~nitoring wells must he notified ??-hours pnc~r to eonst:-uction. 1-800-D1G-TESS, Lone Star Notification
Center t 1-REl(~-669-~~441 and S~~uthwestern Be]i Telephc~ne (1-800-8?8-5127) numbers must be notified 48
hc~ui~s priar to construction f~r e~xisting u~ilit~~ locations
I. Construction ~ians and ,pec~fications i~or all work proposed will be submitted to the
l~epartment of Engineenng for approval ~rior io beginnin~ construction. The plans must show the depth and
1~~~:ati~r~ of ~hc~ proposed e~nstn~ction and .iistance from tr~e existing water. storm, wastewater, and gas lines.
J. Perm~ttee v~~ill repair or c<~~se tt? be repair~~d any damage to any landscaping, sidewalks, curb
and ~utter, cinveway, street, san~tary sewer, storm sewer, drainage facility, underground lines, wires ar pipes
i~v~>ned by the City of C~~rpus C'nristi or t:c~lder~ of anv franchise from the City, resulting from or caused by
reason of constructioii.. operatio~i, maintenance and/or rer~io~~al of said monitoring wells.
K A C it~v Inspectc>r may rea uest u utility linc~ to be uncovered to verify its depth and/or location.
:~ll backfill and repairs of any kind will be made accordin~ to City standards and/or City Inspector's request.

Q Pemimee shall adiust or ~-elocate the abo~~e described monitoring wells at its own expense, if
necessary Eor the present or futt:re construction of any pu~lic utilities, or change in street grade or pattern on
the streeEs or for anv ~~tner reas~~n ~~f the +'it~~ ~tated in writing to Permittee.
R The constructiun of the rnonitoring well~~ and Che use of said area hereby granted sha11 in no
~~a}~ mterfere with the construction or operation by the Ciry or any of its franchisees of any existing or future
proposed s~dewalks, utilitv lines, or other uses. or the maintenance thereof. If City (or any company with
existing uti lities located iri said ~ ight-of ~ ay j needs access to the right-of-way containing the monitoring wells,
Permittce shall be responsible f.~r either repainn~= the monitoring wells to their original eondition orremoving
the tr~onitoring wells at U hich ume this ?~~1onitt~nng w'ell Permit shall terminate immediately.
S. The n~hts of constructi~~~i conierred herein shall not be assigned by Permittee without the
.~:~ior ~~ritten :,onsent of the C'it~~ of~Corpus Chri;,ti.
T. The Monitoring Well Perm~t remains in effect during the Permittee's investigation and
assessment ot possible petroleum contamination. Howe~~er, the Monitoring Well Permit expires 24 months
from the date of issuance Upot~ eomplet<<~n of the invest~gation and assessment the monitoring wells will be
removed ir: accordance with the then c:~rren~ requirements of the City of Corpus Christi and the Texas
t'ummissic?n :~n En~•ironmentai Qualit~ ..~~ its successor a~:enc~ in Austin, Texas. Provided, however, that if at
the end of sai~ 24-montn perioci. the TC~ C1 requires additonal monitoring of the well, then the City shall grant
tc~ Permittee an additi~nal 24-m~~nth peric ~d in u hich to perform the work underthis pernutprovided Permittee
~~avs an ac~ditiona! ~~'?C~_OC~ to Cit~~ for xhe ~~~-month extension. The Permittee shall notify the City's
I~e~art~en± ~f Development Services, A7'TN.._ S ep cial S~n~ices Engineer 48 hours prior to removal of said
monitoris~„.T ~ e11 .

~. Perrnittee must not comrnence work under this agreement until all insurance required herein has been
obtained and such insurance has been approved by the City. The Permittee must not allow any
subcontractor to commence work unti l all similar insurance required of the subcontractor has been so
obtaine~i.
B Perrnittee must furnish to the City ~ Risk Manager, two (2) copies of Certificates ofInsurance, showing
the follo~ving minimum cuverage E~y insurance company(s) acceptable to the City's Risk Manager. The
City must be named as an additional insured fc~r the General liability policy. A blanket waiver of
subrogation is required on all appl~cable policies

~. Permittee must ~btain workers~ ~ompensation coverage through a licensed insurance company in
accordance with Texas law. The eontract for coverage must be written on a policy with endorsements
appr~ved by the Texas Departm~nt of (nsurance. The coverage must be amounts sufficient to assure
that all workers' t•ompensation ~~bligations inciirred by the Permittee will be promptly met.

* The City of Corpus Christi must be narned as an additional insured on the General liability
