Box 9277, Corpus Christi, Texas 78469-9277 (City) acting through its duly authorized City Man~er or Designee (City Manager) and Shiner Moseley and Associates, Inc., 555 N. Carancahua, Suite 1650, Corpus Christi, Texas 78478 (Engineer-A/E), hereby agree to the fallowing amendment of the Seawall Investigation Project Contract for Engineering and Consulting Services approved March 24, 1998 (M98-085), and as administratively amended February 11 1999, March 26, 1999, and December 20, 1999, and as approved by Council May 29, 2001, (M2001-208), and January 15, 2002 (M2002-022), as approved by Council on Apr~l 30. 2002 (M2002-1250), as approved by Council on ~ctober 29, 2002 (M2002-360), November 19, 2002 (M2002-383), as administratively amended on December 18, 2002, as approved by Council March 4, 2003 (M2003-091) and on June 24. 2003 (M2003-227) and as administratively amended on July 3, 2003, and as approved by Council August 26, 2003 (M2003-304), and as approved by Council ~ebruary 17, 2004 (M2004-063). and approved by Council July 27, 2004 (M2004-284) and approved by Council December 21, 2004 (M2004-460) and approved by Council August 30, 2005 (M2005-305) and administratively approved July 3, 2006 and by ~ouncfl (Jctober 17, 2006 (M2006-339) and administratively amended December 1, 2006 agree to the following amendment: Section 1- Scope of Project is amended by: Ratification to authorize payment for additional engineering design and construction phase services for additional design, construction observation, project control, contract administration and quality assurance services associated with Contract D for: • Preparation of plan overview and specifications and project managements, and ~uality assurance services for the construction of 80 L.F. (+/-) of 42-in. RCP storm ~vater pipe across north bound Shoreline Drive into Furman Avenue; and • Preparation of additional plans, project management and quality assurance services far the construction of two t2) ADA access ramps onto the Seawall apron on each side of Lawrence Avenue. Ratification to authorize payment for services to accommodate future installation of Furman storm water outfall and additional ADA access. 5. FEE - Section 5 Fee is amended to read as follows: The City will pay the A/E a fee, for providing services authorized. DISCLOSURE OF INTEREST A/E ft~rther agrees, in compliance with City of Corpus Christi Ordinance No. 17112, to com~ete as part of this contract the Disclosure of Interests form attached hereto as Exhibit D. All other terms and conditions of the March 24, 1998 contract, as amended, between the City and Consultant will remain in full force and effect. SCOPE a Preparation of plan overview and specifications and project managements, and quality assurance services for the construction of 80 L.F. (+/-) of 42-in. FEES A. Fee for Basic Services. The City will pay the Engineer a fixed fee for providing for `Basic Services" authorized in Section 1.A.1-2 above, and for all expenses incurred in performing these services The City will pay a not to exceed fee for services authorized in Amendment No. 15 "Basic Services" Section 1.A.3 (Construction Phase) based on the actual hours incurred based on the hourly rate set forth for Contract D. The fees for Basic Serv~ces will not exceed those identified and will be full an total compensation for all services outlined. For services provided in Section 1 A.1-3, Engineer will submit monthly statements for basic services rendered.), the statement will be based upon Engineer's estimate (and City Concurrence) of the proportion of the total services actually completed at the time of billing. City w~ll make prompt monthly payments in response to Engineer's monthly statements. B, Fee for Additional Services. For services authorized by the Director of Engineenng Services under Section I.B. "Additional Services", the City will pay the Engirteer a fixed fee according to the table below in monthly progress payments based on the engineer's estimate of percentage of completion. C.
