Spec~sl Provisions
l. As t~urther consideration for this Utility Easement, Grantee is obligated to
~onstrt~ct and install a six :nch (6"'~~ water line to service Walgr.eens prior to Grantor paving and

~. Grantee shall be obligateci to restore the surface of the Property, at
Urantee'~ sole cost and expense_ including the restoration of any sidewalks, driveways,
fandsc~p~n~, or similar surface impi•ovements located upon or adjacent to the Easement which
mati have heen removed, relocated. altered, damaged, or destroyed as a result of Grantee's use of
the easement granted he1•eunder. ~~l1 c~~nstructio~l is to be done in a prudent and workmanlike
manner.
TO HAVE AND Tt) HOLL~~ ALI AND ~INGULAR, the rights and privileges aforesaid
to Ura~tee, its successors, legal representatives, arid franchisees for the use as a utility easement
and right-of-way for so long as used for such purpose, and if the use of said easement and right
