This methodology will be implemented once during Year 3(fee of $4,500.00) and once during Year 5(fee of $4,950.00). Data from these surveys will be included in Appendix C of the annual reports. Schedule and Summary of Fees is amended as described in the attached Exhibit "A-1." All other terms and conditions of the Contract and Amendments between the City and Consultant will remain in full force and effect. Our existing contract requires us to provide c~ne year of pre-construction (baseline) monitoring and four years of post-construction monitoring. Dela~ s in the constructi~n of the Packery Channel project have resulted in the accutnulation of` t~~~o years of baseline data. Meetings between the City, HDR~Shiner Moseley, and the 'V~ollie Beattie `Vlanagement Team have resulted in the decision that two years of hase~ine monitoring and 3 years of post-construction moni~toring will be acceptable. (See attac~ed letter from Texas General Land Office) Monitoring seasons for ~'ear 1('vov i)3-Mar. 04) and Year 2(Nov. 04-Mar. OS) have been completed. '~he City, HDR~Shiner Moseley, and the Mollie Beattie Management Team have agreed that due ta the delay in cc~nstruction of Packery Channel, no monitoring should occur f`rom November ?005 to 'vlarch 2006. Monitoring has resumed in November 2006 with Year 3 (Nc7v. (}b-Mar. 0?> and ~~~ill end ~n March 2009 (Year 4 will be Nov. 07-Mar. 0$ and Year 5 ~~~ill be ti~v. 08-Mar. ~9). We request that our contract with the City be amended to reflect this revised project sehedule ( See Exhibit A-2). ~s vou know, the Corps' contractor was delayed in finishing construction of the project. These were absorbed by us without cost to the City.~ ~ ~~'hen ~~~e developed our c~riginal ~roposal for the City, the costs were based upon doing each } ear in >equence. An a1low~tnce was built in for escalation cost each year through the fifth year. Our annual cost increases for salaries, insurance, rent, etc needed to be addressed. This was f~etored into the price we agreed tr~ in the contract. We did not build in unknown additional escal~tion cc~sts on the cl~ance that the project might be delayed. It was assumed that the cantractor would meet his schedule and there would be no skipping of years. As a result, as the last t~ee y~trs were all mc~ved back b~ a year, we are faced with an additional year of esca,~i€#ion c~sts through no fau~t of our own. In ]ooking back, if ~~re had stopped work before beginning Year 2 to obtain Management Team ~ concurrence on whether tc~ proceed~ we would have requested additional funding from the City fi}r tl~ese ~Zegotiatic~ns. The effort ~~ould have been similar to what was expended to get the after-~e-fact approval, or about $ i~,00C), We would ihen have requested that the escalated c~sts be covered. but there would have been an extra year to be escalated. Because we spent our own money to ~~rork ~~ith the ~~~cam <m concui•rence for skipping the year, ~the City was saved tl~is $15,000 expense_ The e~;calation costs woutd have been requested in either case. We submitted a request t~: amend tllis ~ontract on February 17. 2006 (enclosed). A proposal for a~ditional fees resulting f~rom the ~~elaved project schedule was included in the February 2006 request. While an annual escalation rate was not formally identified in~ our contract, each year was priced to accoun or~increasec~costs o~ing~iusiness. In a July 0, 2006 meeting with Ms. Carolyn Murphy and Dr. Terry Roberts of I.S. :~rmy Corps of Engineers, it was decided that additional sur~~ey data should be collected a]ong two prev~ously surveyed transects. Tom Utter was in attendance and asked HDR~Shiner Moseley to provide him with a proposal for the additional sur~ eys ~ proposal for this work and ihe additional fees for project delays was submitted to '~~r. Utter ,~n Augu,t 7. 2006 (encl~~sed). The surveys can be provided in Year 3 and Year 5 for lump sum ~mounts of $4.500 and $4,950 respectively. Tht methodology for collecting benthic samples includes ~~ alkin~ t~~o transects (pre-selected), collecting five care samples at ~~arious le~ els of ir~iindation, and sending the samples to a lab for processing. The su~~ested metl7od f~ti~ collection is with a 2-inch PVC boring core with a recc~mmen~ied dia~~ieter pfi 5.4 cm. The recommended depth within the sediment f~~r pullin~~ core samples is approximately 5 cm. Benthic analyses will con,ist ~f ~~aentifyi~~~; inv~rtebrates to Family, identifying insect larvae to Order, an~i detern7inin~ sp~:cies diversit_y, abundance and biomass. d. Tide Gauge Elevations. T'ide elevations will be retrieved from the Packery ('hannel ti~ie gauge information a~ia internet. The elevations selected will be those taker~ directl~ off~ the Packery Channel internet site at the same time the benthic cornmunity ~amples were being collected. In addition, while onsite for the avian;'}~enthic ~~~onitoring, tu-o i~~easurements will be taken within the benth~c stu~ly area. One ~~Ieasure~nent will be taken from the first stake of the heiithic stu~iy area houndary to tlie waters edge, and the second measurement w~;l be tak~~n from the f~urthest stake zo the waters edge. The stakes on either en~i ~~t~the ~~reviousi,~ usecl benthic study area will be used to create a polygon of a~~ailable s~arface a~-~a. No additional field work shall be required at the referenct~ site (iv) Reporting. I f the TG LO determines the information from the preference ~~te fs acceptahle to the TGLO then incorporate it into the hasc line and annual report~,. ~~'. :~DDITIONAL SE~RVICEti TO BE DETERMINED T}~is section defines the scope f~~r additional services that may be included as part of this eontract but the Engir~eer titi~ill not begin work on this section without specific written approval by the Director of Engineenng Services. Fees for Additional Services will be deterininecl at the time such serv~ces are authorized and will be negotiated by thcs Director of~ Eiigineeri~~~ Ser~~ices as required. The Engineer will, with written authorization by the Direct~~r of F.ngineerin~ Services, do the following: Field Work. This n~~<<y ~onsist of any of the following: ground truthing or surveyii~l~ alon~ the bascline transects, avian surveys, benthic sampling analyses, or other similar itt~ms as n~~ay h~ authorired by the Director of Engineering Services. _:. Port Hurricane Sur~e~. ~hould the area be stnick by a tropical storm or hurricane, as sc>on as practic~l after th~~ event, a post-hurricane survey shall be done. This proposal is for the following: x) Additional surveying of elevations along previously surveyed transects within MBCHC. ?) Additional fees associated with changes to monitoring schedule. SCOPE OF WORK You have requested that we revisit transects established in Baseline Year 1 of the MBCHC study to collect elevation data at each of the previously surveyed data points. ~-IDR~Shiner Moseley will use global positioning system (GPS) equipment to navigate along the previously surveyed transects (Transects A and B) within MBCHC. An elevation and a GPS point will be taken at each of the data points that were surveyed during Baseline Year l Elevations will be recorded in NAVD 88. GPS points will be taken using a state plene coordinate system. This methodology will be implemented once during 2006 (Year 3) and once during 2008 (~`ear 5). Delays in the North Padre Island Storm Damage and Environmental Restoration Project have resulted in unanticipated changes to the scheduling of Years 3-5 of the MBCHC Monitoring Project. We are requesting an additional $11,300 to compensate for increased costs resulting from this unanticipated change.
