HomeMy WebLinkAboutC2007-045 - 2/13/2007 - Approved 4'TATF OF TEk.:4S COU'VTY OF Ni1EC1F;S [NTERLOCAL AGREEMENT BETWEEN NUECES COUNTY AND CITY OF CORPUS CHRISTI WHEREAS, Nueces (:'ounty, herein _'County" was awarded a Substance Abuse and Mental Health Services .Administration (SAMHSA) Grant, herein "Grant"; WHEREAS, one of the purposes oI~ this Grant is prior to booking divert persons with mentat illness an~'or co-+~~ccurring substance abuse disorders to community based services. WHEREAS, collaboration with <lll entities within '~Iueces County having police protecti~~n and detention powers iy essential for accomplishment of stated purpose; WHF,REAS, the t 'it_y of Corpus t:hristi herein`City" has police protection and detention powers; WHEREAS, Chapter 7~~ ( of the Cexas Government Code, as amended authorized tiontract~ between local governmental agencies to perform governmental functions, in:;lusiv°e of section 791 .025, Teas Government Code which permits agreements between local governments for the purchase ot~ goods and services and satisfies the s-eyuirement of local go~,~ernment~ to seek competitive bids for the purchase of goods and ser~~ices NOW, THEREFORE, THIS A(:RI+:.EMENT is hereby made and entered into by the t_'ity anc: County upon and tier thr mutual considerations stated herein: WITNESSETH Section l . Obligations of City (';ity agrees to the tz~llowing: I. Provide a Crisis Intervention `[~eam (CI"I~) Coordinator/Trainer on an as needed basis to assist with the curriculum development and training of Law Enforcement C~fficers_ Dispatchers and t~orrectional Officers. 2007-045 02! 1310? Res027141 Nueces (ounty Recrwt [=`orpus Christi Police Officers. herein "Officers," for the 40-hour Crisis Intervention Team specialized training. Allow Officers to participate in the 40-hour Crisis Intervention Team specialized training designed to teach: a. ~ aw enforcement safety h. !~~Iental health related topics c. Crisis re<>lution skills d. )fie-escalation training e. access t~~ community-based services 'Maximum number of paid ~'risis Intervention Team slots available 20 per year. Number is subject to change upon written agreement by both parties. 4 C~)evelop internal policies and procedures to utilize trained Corpus Christi Police Department Crisis Intervention 'Team Officers in the field. ~ allow Dispatchers to participate in a 4 hour Crisis Intervention Recognition gaining course designed to teach: a_ Recognition and ~~ssessment of a Mental Health Crisis Event b. Appropriate Questions to Ask Caller c Identify Nearest Crisis Intervention Team Officer d. Policies and Procedures Maximum number of paid Crisis Intervention Recognition slots available 55. Number is subject to change upon written agreement by both parties. b. l ducate Supervisors and Command staff on Crisis Intervention Team policies and rrocedures ?_ Participate ~n Crisis Intervention Team recognition events, training ceremonies, ~~nd community t'risis Intervention Team awareness events. 8. Provide representation for scheduled Project. Advisory Committee Meetings. 9. _~ ssist in obtaining additional funding for the continuation of the Crisis l~~terventi~~n Team training after the Grant ends. 10 Provide Fifty 'Thousand Dollars ($50,000) by February 15, 2007 to the County to be used as a local match for the Crrant. Section 2. Obligations of County Reimburse. the Corpus Christi Police Department the cost of the Officer's 40-hour wages (excluding overtime) for every Officer that completes the Crisis Intervention Team training conducted for the Jail Diversion Program, not to exceed $30I 52.9 Any and all invoices for reimbursement shall be submitted to the County within thirty (ad) days of expenditure. Liability N'othtn<~ in the performance of this Agreement shall impose any liability for claims against County ether than claims for which liability may be imposed by the Texas Tort <'laims Act. Each party to this .Agreement will be responsible for its own action in providing services under this Agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by the ether party. Section 5. Compliance with Laws 111 parties agree to comp]}~ with all applicable cite, state, and federal laws, regulations, ind rules that may pertain to each party's performance under this Agreement. section 9. :Amendment This Agreement may he amended only by written agreement approved by each respective governing body at a noticed meeting and signed b_y~ the County Judge and the City ?~~~Ianager. Section 10. Independent Contractor This Agreement twill not be construed as creating an employer/employee relationship between Contractor and Count~~. Section 11. Venue ~~enuc !or resolution by a court of competent jurisdiction of any dispute arising under the terms o f this Agreement, or for enforcement of the provisions of this Agreement, is specifically set b~ Agreement of the parties in Nueces County, Texas. Section 12. Entirety Clause This .~~greement contains the entire understanding and agreement between the parties, and no oral statements or representations or prior written matter not contained in this Agreement shall have arw force and effect. Section 13.
