HomeMy WebLinkAboutC2007-127 - 3/6/2007 - NASECOND AMENDMENT TO THE CHDO AGREEMENT BETWEEN THE CORPUS CHR~'STI COMMUNITY IMPROVEMEIVT CORPORATION AND THE NUECES COUNTY COMMUNITY ACTION AGENCY This s~econd amendment ("Second Amendment") is made by and between the Corpus Chris~ Community Improvement Corporation ("CCCIC") and the Nueces County Comrnunity Action Agency, hereinafter referred to as a Community Housing Deve~pm~t Organization ("CHDO"1 WHE~tEAS, the CCCIC and the CHDO executed an agreement ("Agreement"), which was aw~proued by the CCCIC on February 10, 2004 (M2004-384), for the purpose of utilizing the CCCIC s FY~J3 HOME Program funds: V1fHE~EAS, the scope of work to be completed under the Agreement included funding down payrr~ents and closing costs on newly constructed homes for homebuyers at or below 80% of Area Family Median Income; WHE~tEAS, the term of the Agreement was 23 months, expiring January 31, 2006; WHE~EAS, on April 27, 2004, the City Council approved a FY04 HOME Program fundir~g allocation ta the CCCIC which included a recommended award of $277,220 to the CNDO ~o fund at a minimum an additional fourteen homebuyers; and VUHEREAS, the parties to the Agreement desire to reinstate the original Agreement and First Amendment and ta execute this Second Amendment to extend the term. Secti~n 1. Section 2 of the Agreement is deleted in its entirety and replaced with the follovv~g lartguage "SECTION 2. AGREEMENT PERIOD This agreernent shall commence on the date of execution by the CHDO and #te CCCIC and shall terminate on July 31, 2008, unless otherwise speci- fically provided by the terms of this agreement." Secti~n 2. By execution of this Second Amendment, the parties agree to reinstate the Agreament and the First Amendment and extend the term of the Agreement an additi~nal 2~ months, expiring July 31: 2008. Secti+IM~ 3. All terms and conditions ~f the Agreement and the First Amendment not chanc,~d by this Second Amendment remain the same and in full force and effect. ?007-12?
