RELEASE OF DEED RESTRICTIONS
AIVD USE LIMITATIONS

WHEREAS, in July of 1974, the Padre Islar~d Investment Corporation, a Texas corporatior~,
deeded 9.676 Acres of land to the City of Carpus Christi, a Texas home rule munici~al
carporation, an July 99, 1974, in connection with a contract providing far the construction and
operation of a sewage treatment plant (the "Deed"); and
WHEREAS, the carporatian formerly known as the Padre Island lnvestment Corporation
~hereinafter called "Padre°} has since dissolved a~d is na longer in existence; and
WH~REAS, Asset Development LP, a Texas Limiteci Pa~tnership is Padre's successor entity
and rtow owns all af Padre's assets, Asset De~elopm~~t LP is authorized #o execute this
release of any af the restrictions or use fimitations from the above-referenced Deed;
WHEREAS, the City desires and Asset Development ~P agrees that: as to a certain partion of
the 9.676 Acres originally deeded in 1974, more particularly, a tract of land that is 0.116 Acres
(5,066.6 SQ.FT.), described by metes and baunds and s~rvey map shown as Exhibit "A", pages
1 and 2, attached and incorparated herein, all use limitations and deed restrictions are reEeased.
NOW, THEREFORE:
GRANTOR, Asset Development LP, for good and valuable consideration, hereby releases
firom the Deed ~led in Nueces County De~d Records, Dacument Na. 937470, Volume 1487,
Pages 201-209, executed on Feb 19, 197'4 (the "Deed"), in which Grantor Padre lsland
Investment Corporation, deeded to the City of Corpus Christi a certain tract of lan~ in Nueces
Cour~ty, Texas described in the Agreement as Point Tesoro Unit 5 Subdi~ision, land aut of Lot 2,
Block 2, Paint Tesaro Unit 5, as shown on Map recorded En Volume 38, Pages 32-33, Map
Records of Nueces County, Texas.
Mare specifically, this instrument releases fram that certain 0.1'i6 Acres tract the #ollowing
restrictive language (found on the first page of the Deed, paragraph 3, sections 1& 2):
"9. The grant herein is specially limifed for so long as the Cify continu~s to use the
Property for the construction, operafion and mainfenance of the sewage treatmenf
facrlifies provided for in the Contracf; and
2. Upon the occurrence of eifher fhe evenf specified rn Paragraph ! of fhe Confract,
fhe City shal! convey the Property fo Padre, its successors and assigns as therein
