TO THE
CDBG SUBRECIP~ENT AGREEMENT
BETWEEN THE
CITY OF CORPUS CHRISTI
AND
AVANCE, INC,
This third amendment ("T~ird Amendment") is made by and be~-rveen Avance, Inc. ("5ub-
recipienY'), and the City of Corpus Christi ("City").
WHEREAS, the City and the Subrecipient executed ar~ agreement ("Agreement"), which was
approved by the Ciky Cauncil on September 'f 3, 2005 (M2005-313), for the purpose of utilizing
the City's FY05 Communi#y Development Bfock Grant ("CDBG") Program funds;
WHEREAS, tl~e Agreement terminates JunE 34, 2007;
WHEREAS, the parties to the Agreement desire to execute this Third Amendment to re~ise and
extend the term stated in the Agreement.
Section 1. Section 9, su~section 9.1, of the Agreement is deleted and replaced with the
#ollawing language:
"9.1 Term. This Agreement terrrtinates February 28, 2008. Extensions to the
term of this Agreement may be requested by the Subrecipient and approved by
the City Mana~er. However, the Subrecipient is bound by all covenants, terms,
ar~d conc~itians of this Agreement including, without iimitatian, recordkeeping, far
a periad of six (6) years commencing an the dat~ of the Subrecipient's execution
of this Agreement, unless a specific bound periad is sharter or longer as may be
stated in this Ag~eement."
Section 2. By execution of this Third Amendment, the parties agree to r~~ise and extend the
term stated in tfi~e Agreement. All terms and conditions of the Agreement not changed by the
First Amendment, Second Amendment, and by this Third Amendment remain the same and in
full farce and effect.
