installing an existing (on-si~e) BpkW dzesel qenerator and automa~ic transfer
switch; praviding and instal~znq a new concrete genera~a~ pad on driZied piers
and new electrical pa~elboard; modifying the existinq electrical d~stribution
system as required for the installatxon and ta serve identifzed HVAC laads and
ather cri~ical equipment; and other re~ated work. Same work will need ~o be
accompiished after normal working hours ~o avoid the interrup~ion of fac~lity
operatians. All work to be in accordance with the plans, spec~fications and
cantract doc~ents;

A pre-bid mee~ing is sc~eduled for 10:00 a.m., WedriesdaYr.,I~y 30, 2007 and will
be conducted by the City. The location of the~meeting will be ~he Aepar~en~
of Eagineering Serviaes Main Conference Room, Third F3~aar, City Hall, 1201
Leopsrd S~reetr Corp~xs Christi., TX, The Consu~tant Engineer will be present to
address ~idder's questians. A site visi~ may ~ol~.ow, if reques~ed.
A bid bond ir~ the amotznt of 5$ of the highest amaun~ bid must accompany each
~~oposal. Failure to provide ~he bid boad wi11 cons~.i~ute a non-respansive
proposal which will not be considered. Failure to p~ovide required perfo~man;ce
and payment bonds for contrac~s over $25,OOO.QO will result in forfeiture of
~.he 5~ bid bond to 'the City as liquidated damages. Bidder's plan depasit is

For each calendar day that any work remains incompZete after the time
specified in the Contract for completion of the work or aft~r such time
period as extended pursuant to ather provisions of this Contract, $l00 p~r
calendar day will be assessed against the Contractor as liquidated damages.
Said liquidated darnages are not imposed as a penalty but as an estimate o£
the damag~s that the City will sustain from delay in completion of the work,

2. Definitions
a. Prime Contrac~or: Any person, fi.rm, par~nership, corporation,
assaciation or joint venture as herein provided which has been
awardad a City contract.
b. Subcontractor: Any named person, firm, pa~tnership, corporation,
association, ar joint ventnre as herein identified as providing
work, labor, services, supplies, equipment, materials or any
combination of Che foregoing under contract with, a prime cantractor
on a City contract.
c. Minori~.y Business Enterprise: A business ente~rise that is owned
and controlled by one or more minority person{s). Minori~y persons
include Blacks, Mexican-Americans and othex persons of Hispar~ic
orzga.n, Amerzcan zndians, Alaskan Natives, and Asians or Pacific
IsZanders. For the purposes of this section, women are also

b_ ~hese goals are appZicable to all the construction work (regard~ess
of federal participation} per€or~ed in the Contract, including
approved change arders. The hours of minorzty employmant must be
substantially uniform throughout the ~eng~h of tihe Contract and in
each trade. The transfer of mino~i~y emp~oyees from Contractor to
Con~ractor or from project to praj~ct for the sole purpose of
meeting the Contractox's percentage is prohibited.
4. Compliance
a. Upon completion of the Project, a finai breakdown of N~E
participation, substantiat~d by copies of paid invaices, shall be
submitted by the Cantractor to ~he Citiy Engineer.
b. The Contractor shall ~ake bi-weekly pay~oll submittaZs to the City
Engineer. The Contractor is to indicate the percent of minority and
female participation, by trade, which has bean utilized an the
Project. Along with the request for final payment on the Project,
the Contractor wi~l indicate, in writing, the overall participation
zn these areas which have been achieved. The City Engineex may
withhold monthly or final payments to the Contractor for ~azlure ta
sub~it bi-weekly payrolls in a timely fashion or to submit overa~I
participation in~armat~an as required.

The Contractor shall provide to th~ Citiy Engineer the signed endors~ments, or
copies th~reoE certi~i~d by the insuxer, within thirty {36) calendar days
after the da~e tihe City Engi~eer reques~s that the Contractor sign the
Con~ract documents.
Within thir~y (30) calendar days after the date the City Engineer raquesrs
that the Con~ractor sign the Contract documents, the Cantractor sha11 provide
~he City Engineer with a cer~ificate of insurance c~rtxfying that the
Contractor provides worker~s compensation insurance coverage for a1~
employees of the Contractnr employed on the Project described in rhe
Contract.
For each insurance coverage pravided in accordance wi~h Section 5-6-11 of the
Contract, the Contractor shall obta~n an endorsement to the applicabla
insurance policy, signed by the insurex, stating that the City is an
additional ins~red under the insurance palicy. ~he City need not be named as
additiona~ insured on Worker's Compensation coverage.
For cdntractual ~iability insurance coverage obtafned in accordance with

To allow the City Engineer ta determine that the bidder is ab~.e to perform
its obligations under ~he prpposed contract, then prior to award, the Ca.ty
Engineer may requi.re a bidder to provide documentation concerning:
1. Whether any liens have been filed against bidder for either failure to
pay for services or materials supplied agains~ any of its projec~s begun
within the preceding two (2) years. The bidder shall specify the name
a~ad address of the party hol.ding the lien, the amaunt of the lien, the
basis for the lien claim, and the date of ~he release of the 1.ien. If

management and oversight of projects of a similar size and complexity to this

beginning work on the Project. ~f the City Engineer does not approve
all proposed subcontractors, it may rescin,d the Contract award.
